{"id":236527,"date":"2020-09-30T18:55:23","date_gmt":"2020-09-30T13:25:23","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=236527"},"modified":"2020-10-09T11:35:35","modified_gmt":"2020-10-09T06:05:35","slug":"del-hc-surprised-at-advocates-moving-court-for-legal-opinion-hc-dismisses-application-under-s-151-cpc","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2020\/09\/30\/del-hc-surprised-at-advocates-moving-court-for-legal-opinion-hc-dismisses-application-under-s-151-cpc\/","title":{"rendered":"Del HC | &#8220;Surprised&#8221; at advocates moving Court for legal opinion, HC dismisses application under S. 151 CPC"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Delhi High Court: <\/strong>A Division Bench of Rajiv Sahai Endlaw and Asha Menon, JJ., dismissed an application filed under Section 151 CPC expressing surprise that advocates moved the application seeking the legal opinion of the Court.<\/p>\n<p style=\"text-align: justify;\">The present application was filed invoking Section 151 of the Code of Civil Procedure, 1908 by the appellant, respondents 3 and 5 seeking clarification on the following:<\/p>\n<div class=\"page\" title=\"Page 2\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<blockquote>\n<p style=\"text-align: justify;\"><span style=\"color: #ff0000;\">&#8220;Whether the share in the property received by a son on the partition of a HUF is \u201cHUF\u201d or \u201cindividual\u201d in his hands?\u201d<\/span><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">Bench stated that &#8220;neither Section 151 CPC nor any other provision of law vests in this Court, acting as the Company Appeal Court, advisory jurisdiction.&#8221;<\/p>\n<p style=\"text-align: justify;\">Court was surprised to note that the advocates are moving applications seeking the legal opinion of the Court. The application is thoroughly misconceived.<\/p>\n<p style=\"text-align: justify;\">Dismissing the matter, Court added that,<\/p>\n<div class=\"page\" title=\"Page 2\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p style=\"text-align: justify;\"><em>&#8220;one of us (Justice Rajiv Sahai Endlaw) will be demitting office on 13th August, 2021 and the advocates are at liberty to approach him for advice at that time, by deferring the execution of the sale deed till then!&#8221;<\/em><\/p>\n<p style=\"text-align: justify;\">Advocate Lalit Gupta stated that he did not even sign the application and his name has just been added without consulting him.
