{"id":236296,"date":"2020-09-25T19:25:46","date_gmt":"2020-09-25T13:55:46","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=236296"},"modified":"2020-12-10T19:53:06","modified_gmt":"2020-12-10T14:23:06","slug":"all-hc-offences-under-ss-498-a-ipc-and-3-4-of-dowry-prohibition-act-compounded-in-light-of-settlement-between-parties","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2020\/09\/25\/all-hc-offences-under-ss-498-a-ipc-and-3-4-of-dowry-prohibition-act-compounded-in-light-of-settlement-between-parties\/","title":{"rendered":"All HC | Offences under Ss. 498-A IPC and 3\/4 of Dowry Prohibition Act compounded in light of settlement between parties"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Allahabad High Court:\u00a0<\/strong>Dr Kaushal Jayendra Thaker, J., addressed a matter with regard to the settlement of divorce proceedings.<\/p>\n<p style=\"text-align: justify;\">Parties in the present petition have deposed before the Court below that they have entered into a compromise.<\/p>\n<p style=\"text-align: justify;\">Hence, in view of the above, the petition is taken for final disposal.<\/p>\n<p style=\"text-align: justify;\">It has been observed that certain offences were non-compoundable and they were within the power of Magistrate to compound namely under Sections 498-A of Penal Code, 1860 and 3\/4 of the Dowry Prohibition Act.<\/p>\n<p style=\"text-align: justify;\"><a href=\"http:\/\/www.scconline.com\/DocumentLink\/bAf79H8r\"><b>Section 498A:<\/b><\/a>\u00a0Husband or relative of husband of a woman subjecting her to cruelty.\u2014Whoever, being the husband or the relative of the husband of a woman, subjects such woman to cruelty shall be punished with imprisonment for a term which may extend to three years and shall also be liable to fine<\/p>\n<p style=\"text-align: justify;\"><a href=\"http:\/\/www.scconline.com\/DocumentLink\/fFVE8hB9\"><b><span id=\"Highlight_0013\" class=\"Highlight\">Section 3:<\/span>\u00a0<span id=\"Highlight_0014\" class=\"Highlight\">Penalty<\/span>\u00a0<span id=\"Highlight_0015\" class=\"Highlight\">for<\/span>\u00a0<span id=\"Highlight_0016\" class=\"Highlight\">giving<\/span>\u00a0<span id=\"Highlight_0017\" class=\"Highlight\">or<\/span>\u00a0<span id=\"Highlight_0018\" class=\"Highlight\">taking<\/span>\u00a0<span id=\"Highlight_0019\" class=\"Highlight\">dowry<\/span><\/b><\/a><\/p>\n<p style=\"text-align: justify;\"><a href=\"http:\/\/www.scconline.com\/DocumentLink\/gV8EzmiW\"><b><span id=\"Highlight_0011\" class=\"Highlight\">Section 4:<\/span>\u00a0<span id=\"Highlight_0012\" class=\"Highlight\">Penalty<\/span>\u00a0<span id=\"Highlight_0013\" class=\"Highlight\">for<\/span>\u00a0<span id=\"Highlight_0014\" class=\"Highlight\">demanding<\/span>\u00a0<span id=\"Highlight_0015\" class=\"Highlight\">dowry<\/span><\/b><\/a><\/p>\n<p style=\"text-align: justify;\">Further, it was noted that both the parties, i.e. the husband and wife and other family members settled the matter and decided to leave in peace after taking divorce.<\/p>\n<p style=\"text-align: justify;\">The Court was of the view that the settlement between the parties should be accepted and the offence compounded. The decision of the Supreme Court in <em>Bitan Sengupta v. State of W.B.,\u00a0<\/em><a href=\"http:\/\/www.scconline.com\/DocumentLink\/2J83o52E\">(2018) 18 SCC 366<\/a> was referred.<\/p>\n<p style=\"text-align: justify;\">Therefore, proceedings were quashed and settlement was recorded under Section 482 CrPC. In Supreme Court&#8217;s decision in\u00a0<em>B.S. Joshi v. State of Haryana,\u00a0<\/em><a href=\"http:\/\/www.scconline.com\/DocumentLink\/0xy0ey05\">(2003) 4 SCC 675<\/a>, it was observed that in matrimonial offences, it becomes the duty of the Court to encourage genuine settlement of matrimonial disputes.<\/p>\n<p style=\"text-align: justify;\">Bench exercising its powers under Section 482 read with 397 of CrPC, 1973 permitted the parties to leave in peace.<\/p>\n<p style=\"text-align: justify;\"><a href=\"http:\/\/www.scconline.com\/DocumentLink\/987ouxOT\">Section 482 CrPC: <span id=\"Highlight_0015\" class=\"Highlight\">Saving<\/span>\u00a0<span id=\"Highlight_0016\" class=\"Highlight\">of<\/span>\u00a0<span id=\"Highlight_0017\" class=\"Highlight\">inherent<\/span>\u00a0<span id=\"Highlight_0018\" class=\"Highlight\">powers<\/span>\u00a0<span id=\"Highlight_0019\" class=\"Highlight\">of<\/span> the\u00a0<span id=\"Highlight_0020\" class=\"Highlight\">High<\/span>\u00a0<span id=\"Highlight_0021\" class=\"Highlight\">Court<\/span>.<\/a><\/p>\n<blockquote>\n<p style=\"text-align: justify;\">Nothing in this\u00a0<span id=\"Highlight_0022\" class=\"Highlight\">Code<\/span>\u00a0shall be deemed to limit or affect the\u00a0<span id=\"Highlight_0023\" class=\"Highlight\">inherent<\/span>\u00a0<span id=\"Highlight_0024\" class=\"Highlight\">powers<\/span>\u00a0<span id=\"Highlight_0025\" class=\"Highlight\">of<\/span>\u00a0the\u00a0<span id=\"Highlight_0026\" class=\"Highlight\">High<\/span>\u00a0<span id=\"Highlight_0027\" class=\"Highlight\">Court<\/span>\u00a0to make such orders as may be necessary to give effect to any order under this\u00a0<span id=\"Highlight_0028\" class=\"Highlight\">Code<\/span>, or to prevent abuse\u00a0<span id=\"Highlight_0029\" class=\"Highlight\">of<\/span>\u00a0the process\u00a0<span id=\"Highlight_0030\" class=\"Highlight\">of<\/span>\u00a0any\u00a0<span id=\"Highlight_0031\" class=\"Highlight\">Court<\/span>\u00a0or otherwise to secure the ends\u00a0<span id=\"Highlight_0032\" class=\"Highlight\">of<\/span>\u00a0justice.<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\"><a href=\"http:\/\/www.scconline.com\/DocumentLink\/Z7v73u6U\">Section 397 CrPC: <span id=\"Highlight_0018\" class=\"Highlight\">Calling<\/span>\u00a0<span id=\"Highlight_0019\" class=\"Highlight\">for<\/span>\u00a0<span id=\"Highlight_0020\" class=\"Highlight\">records<\/span>\u00a0<span id=\"Highlight_0021\" class=\"Highlight\">to<\/span>\u00a0<span id=\"Highlight_0022\" class=\"Highlight\">exercise<\/span>\u00a0<span id=\"Highlight_0023\" class=\"Highlight\">of<\/span>\u00a0<span id=\"Highlight_0024\" class=\"Highlight\">powers<\/span>\u00a0<span id=\"Highlight_0025\" class=\"Highlight\">of<\/span>\u00a0<span id=\"Highlight_0026\" class=\"Highlight\">revision<\/span><\/a><\/p>\n<blockquote>\n<p class=\"j2\" style=\"text-align: justify;\">(1) The High Court or any Sessions Judge may call\u00a0<span id=\"Highlight_0027\" class=\"Highlight\">for<\/span>\u00a0and examine the record\u00a0<span id=\"Highlight_0028\" class=\"Highlight\">of<\/span>\u00a0any proceeding before any inferior\u00a0<span id=\"Highlight_0029\" class=\"Highlight\">Criminal<\/span>\u00a0Court situate within its or his local jurisdiction\u00a0<span id=\"Highlight_0030\" class=\"Highlight\">for<\/span>\u00a0the purpose\u00a0<span id=\"Highlight_0031\" class=\"Highlight\">of<\/span>\u00a0satisfying itself or himself as\u00a0<span id=\"Highlight_0032\" class=\"Highlight\">to<\/span>\u00a0the correctness, legality or propriety\u00a0<span id=\"Highlight_0033\" class=\"Highlight\">of<\/span>\u00a0any finding, sentence or order, recorded or passed, and as\u00a0<span id=\"Highlight_0034\" class=\"Highlight\">to<\/span>\u00a0the regularity\u00a0<span id=\"Highlight_0035\" class=\"Highlight\">of<\/span>\u00a0any proceedings\u00a0<span id=\"Highlight_0036\" class=\"Highlight\">of<\/span>\u00a0such inferior Court, and may, when\u00a0<span id=\"Highlight_0037\" class=\"Highlight\">calling<\/span>\u00a0<span id=\"Highlight_0038\" class=\"Highlight\">for<\/span>\u00a0such record, direct that the execution\u00a0<span id=\"Highlight_0039\" class=\"Highlight\">of<\/span>\u00a0any sentence or order be suspended, and if the accused is in confinement, that he be released on bail or on his own bond pending the examination\u00a0<span id=\"Highlight_0040\" class=\"Highlight\">of<\/span>\u00a0the record.<\/p>\n<p class=\"j2\" style=\"text-align: justify;\"><i>Explanation.\u2014<\/i>All Magistrates, whether Executive or Judicial, and whether exercising original or appellate jurisdiction, shall be deemed\u00a0<span id=\"Highlight_0041\" class=\"Highlight\">to<\/span>\u00a0be inferior\u00a0<span id=\"Highlight_0042\" class=\"Highlight\">to<\/span>\u00a0the Sessions Judge\u00a0<span id=\"Highlight_0043\" class=\"Highlight\">for<\/span>\u00a0the purposes\u00a0<span id=\"Highlight_0044\" class=\"Highlight\">of<\/span>\u00a0this sub-<span id=\"Highlight_0045\" class=\"Highlight\">section<\/span>\u00a0and\u00a0<span id=\"Highlight_0046\" class=\"Highlight\">of<\/span>\u00a0<span id=\"Highlight_0047\" class=\"Highlight\">Section<\/span>\u00a0398.<\/p>\n<p class=\"j2\" style=\"text-align: justify;\">(2) The\u00a0<span id=\"Highlight_0048\" class=\"Highlight\">powers<\/span>\u00a0<span id=\"Highlight_0049\" class=\"Highlight\">of<\/span>\u00a0<span id=\"Highlight_0050\" class=\"Highlight\">revision<\/span>\u00a0conferred by sub-<span id=\"Highlight_0051\" class=\"Highlight\">section<\/span>\u00a0(1) shall not be exercised in relation\u00a0<span id=\"Highlight_0052\" class=\"Highlight\">to<\/span> any interlocutory order passed in any appeal, inquiry, trial or other proceedings.<\/p>\n<p style=\"text-align: justify;\">(3) If an application under this\u00a0<span id=\"Highlight_0053\" class=\"Highlight\">section<\/span>\u00a0has been made by any person either\u00a0<span id=\"Highlight_0054\" class=\"Highlight\">to<\/span>\u00a0the High Court or\u00a0<span id=\"Highlight_0055\" class=\"Highlight\">to<\/span>\u00a0the Sessions Judge, no further application by the same person shall be entertained by the other\u00a0<span id=\"Highlight_0056\" class=\"Highlight\">of<\/span>\u00a0them.<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">Court quashed the proceedings under Section 397 CrPC and allowed the petition.<\/p>\n<p style=\"text-align: justify;\">The petitioner&#8217;s counsel pointed the orders passed by the Court below and hence the bench defied the proceedings if not yet defied.
