Allahabad High Court:\u00a0<\/strong>Dr Kaushal Jayendra Thaker, J., addressed a matter with regard to the settlement of divorce proceedings.<\/p>\n

Parties in the present petition have deposed before the Court below that they have entered into a compromise.<\/p>\n

Hence, in view of the above, the petition is taken for final disposal.<\/p>\n

It has been observed that certain offences were non-compoundable and they were within the power of Magistrate to compound namely under Sections 498-A of Penal Code, 1860 and 3\/4 of the Dowry Prohibition Act.<\/p>\n

Section 498A:<\/b><\/a>\u00a0Husband or relative of husband of a woman subjecting her to cruelty.\u2014Whoever, being the husband or the relative of the husband of a woman, subjects such woman to cruelty shall be punished with imprisonment for a term which may extend to three years and shall also be liable to fine<\/p>\n

Section 3:<\/span>\u00a0Penalty<\/span>\u00a0for<\/span>\u00a0giving<\/span>\u00a0or<\/span>\u00a0taking<\/span>\u00a0dowry<\/span><\/b><\/a><\/p>\n

Section 4:<\/span>\u00a0Penalty<\/span>\u00a0for<\/span>\u00a0demanding<\/span>\u00a0dowry<\/span><\/b><\/a><\/p>\n

Further, it was noted that both the parties, i.e. the husband and wife and other family members settled the matter and decided to leave in peace after taking divorce.<\/p>\n

The Court was of the view that the settlement between the parties should be accepted and the offence compounded. The decision of the Supreme Court in Bitan Sengupta v. State of W.B.,\u00a0<\/em>(2018) 18 SCC 366<\/a> was referred.<\/p>\n

Therefore, proceedings were quashed and settlement was recorded under Section 482 CrPC. In Supreme Court’s decision in\u00a0B.S. Joshi v. State of Haryana,\u00a0<\/em>(2003) 4 SCC 675<\/a>, it was observed that in matrimonial offences, it becomes the duty of the Court to encourage genuine settlement of matrimonial disputes.<\/p>\n

Bench exercising its powers under Section 482 read with 397 of CrPC, 1973 permitted the parties to leave in peace.<\/p>\n

Section 482 CrPC: Saving<\/span>\u00a0of<\/span>\u00a0inherent<\/span>\u00a0powers<\/span>\u00a0of<\/span> the\u00a0High<\/span>\u00a0Court<\/span>.<\/a><\/p>\n

\n

Nothing in this\u00a0Code<\/span>\u00a0shall be deemed to limit or affect the\u00a0inherent<\/span>\u00a0powers<\/span>\u00a0of<\/span>\u00a0the\u00a0High<\/span>\u00a0Court<\/span>\u00a0to make such orders as may be necessary to give effect to any order under this\u00a0Code<\/span>, or to prevent abuse\u00a0of<\/span>\u00a0the process\u00a0of<\/span>\u00a0any\u00a0Court<\/span>\u00a0or otherwise to secure the ends\u00a0of<\/span>\u00a0justice.<\/p>\n<\/blockquote>\n

Section 397 CrPC: Calling<\/span>\u00a0for<\/span>\u00a0records<\/span>\u00a0to<\/span>\u00a0exercise<\/span>\u00a0of<\/span>\u00a0powers<\/span>\u00a0of<\/span>\u00a0revision<\/span><\/a><\/p>\n

\n

(1) The High Court or any Sessions Judge may call\u00a0for<\/span>\u00a0and examine the record\u00a0of<\/span>\u00a0any proceeding before any inferior\u00a0Criminal<\/span>\u00a0Court situate within its or his local jurisdiction\u00a0for<\/span>\u00a0the purpose\u00a0of<\/span>\u00a0satisfying itself or himself as\u00a0to<\/span>\u00a0the correctness, legality or propriety\u00a0of<\/span>\u00a0any finding, sentence or order, recorded or passed, and as\u00a0to<\/span>\u00a0the regularity\u00a0of<\/span>\u00a0any proceedings\u00a0of<\/span>\u00a0such inferior Court, and may, when\u00a0calling<\/span>\u00a0for<\/span>\u00a0such record, direct that the execution\u00a0of<\/span>\u00a0any sentence or order be suspended, and if the accused is in confinement, that he be released on bail or on his own bond pending the examination\u00a0of<\/span>\u00a0the record.<\/p>\n

Explanation.\u2014<\/i>All Magistrates, whether Executive or Judicial, and whether exercising original or appellate jurisdiction, shall be deemed\u00a0to<\/span>\u00a0be inferior\u00a0to<\/span>\u00a0the Sessions Judge\u00a0for<\/span>\u00a0the purposes\u00a0of<\/span>\u00a0this sub-section<\/span>\u00a0and\u00a0of<\/span>\u00a0Section<\/span>\u00a0398.<\/p>\n

(2) The\u00a0powers<\/span>\u00a0of<\/span>\u00a0revision<\/span>\u00a0conferred by sub-section<\/span>\u00a0(1) shall not be exercised in relation\u00a0to<\/span> any interlocutory order passed in any appeal, inquiry, trial or other proceedings.<\/p>\n

(3) If an application under this\u00a0section<\/span>\u00a0has been made by any person either\u00a0to<\/span>\u00a0the High Court or\u00a0to<\/span>\u00a0the Sessions Judge, no further application by the same person shall be entertained by the other\u00a0of<\/span>\u00a0them.<\/p>\n<\/blockquote>\n

Court quashed the proceedings under Section 397 CrPC and allowed the petition.<\/p>\n
