Central Information Commission (CIC): <\/strong>Amita Pandove (Information Commissioner) while addressing the present second appeal observed that the exemption of Section 8(1)(j) of the RTI Act can only be claimed when the information sought relates to the personal information of a third party.<\/p>\n

Information Sought<\/span><\/p>\n

Appellant had sought certified copies of the delivery sheet of the article\/ registered speed post letter along with the date and time and name of the postman who delivered the same to the concerned authorities.<\/p>\n

CPIO denied the information under Section 8(1)(j) of the RTI Act, 2005.<\/p>\n

Section 8 of the RTI Act, 2005 talks about Exemption from disclosure of information<\/a><\/p>\n

\n

(j) information<\/span>\u00a0which relates\u00a0to<\/span>\u00a0personal\u00a0information<\/span>\u00a0the\u00a0disclosure<\/span>\u00a0of<\/span>\u00a0which has no relationship\u00a0to<\/span>\u00a0any public activity or interest, or which would cause unwarranted invasion\u00a0of<\/span>\u00a0the privacy\u00a0of<\/span>\u00a0the individual unless the Central Public\u00a0Information<\/span>\u00a0Officer or the State Public\u00a0Information<\/span>\u00a0Officer or the Appellate Authority, as the case may be, is satisfied that the larger public interest justifies the\u00a0disclosure<\/span>\u00a0of<\/span>\u00a0such\u00a0information<\/span>:<\/p>\n

Provided that the\u00a0information<\/span>\u00a0which cannot be denied\u00a0to<\/span>\u00a0the Parliament or a State Legislature shall not be denied\u00a0to<\/span>\u00a0any person.<\/p>\n<\/blockquote>\n

On being dissatisfied, the first appeal was sought and on the ground of unsatisfactory reply in the first appeal from the respondent, Second Appeal was filed under Section 19 of the RTI Act.<\/p>\n

Section 19: Appeal<\/a><\/p>\n

\n

(1) Any person who, does not receive a decision within the time specified in sub-section<\/span>\u00a0(1) or clause (a<\/i>) of sub-section<\/span>\u00a0(3) of\u00a0Section<\/span>\u00a07, or is aggrieved by a decision of the Central Public\u00a0Information<\/span>\u00a0Officer or State Public\u00a0Information<\/span>\u00a0Officer, as the case may be, may within thirty days from the expiry of such period or from the receipt of such a decision prefer an\u00a0appeal<\/span>\u00a0to<\/span>\u00a0such officer who is senior in rank\u00a0to<\/span>\u00a0the Central Public\u00a0Information<\/span>\u00a0Officer or State Public\u00a0Information<\/span>\u00a0Officer as the case may be, in each public authority:<\/p>\n

Provided that such officer may admit the\u00a0appeal<\/span>\u00a0after the expiry of the period of thirty days if he or she is satisfied that the appellant was prevented by sufficient cause from filing the\u00a0appeal<\/span>\u00a0in time.<\/p>\n

(2) Where an\u00a0appeal<\/span>\u00a0is preferred against an order made by a Central Public\u00a0Information<\/span>\u00a0Officer or a State Public\u00a0Information<\/span>\u00a0Officer, as the case may be, under\u00a0Section<\/span>\u00a011\u00a0to<\/span>\u00a0disclose third-party\u00a0information<\/span>, the\u00a0appeal<\/span>\u00a0by the concerned third party shall be made within thirty days from the date of the order.<\/p>\n

(3) A second\u00a0appeal<\/span>\u00a0against the decision under sub-section<\/span>\u00a0(1) shall lie within ninety days from the date on which the decision should have been made or was actually received, with the Central\u00a0Information<\/span>\u00a0Commission or the State\u00a0Information<\/span>\u00a0Commission:<\/p>\n

Provided that the Central\u00a0Information<\/span>\u00a0Commission or the State\u00a0Information<\/span>\u00a0Commission, as the case may be, may admit the\u00a0appeal<\/span>\u00a0after the expiry of the period of ninety days if it is satisfied that the appellant was prevented by sufficient cause from filing the\u00a0appeal<\/span>\u00a0in time.<\/p>\n

(4) If the decision of the Central Public\u00a0Information<\/span>\u00a0Officer or State Public\u00a0Information<\/span>\u00a0Officer, as the case may be, against which an\u00a0appeal<\/span>\u00a0is preferred relates\u00a0to<\/span>\u00a0information<\/span>\u00a0of a third party, the Central\u00a0Information<\/span>\u00a0Commission or State\u00a0Information<\/span>\u00a0Commission, as the case may be, shall give a reasonable opportunity of being heard\u00a0to<\/span>\u00a0that third party.<\/p>\n

(5) In any\u00a0appeal<\/span>\u00a0proceedings, the onus\u00a0to<\/span>\u00a0prove that a denial of a request was justified shall be on the Central Public\u00a0Information<\/span>\u00a0Officer or State Public\u00a0Information<\/span>\u00a0Officer, as the case may be, who denied the request.<\/p>\n

(6) An\u00a0appeal<\/span>\u00a0under sub-section<\/span>\u00a0(1) or sub-section<\/span>\u00a0(2) shall be disposed of within thirty days of the receipt of the\u00a0appeal<\/span>\u00a0or within such extended period not exceeding a total of forty-five days from the date of filing thereof, as the case may be, for reasons\u00a0to<\/span>\u00a0be recorded in writing.<\/p>\n

(7) The decision of the Central\u00a0Information<\/span>\u00a0Commission or State\u00a0Information<\/span>\u00a0Commission, as the case may be, shall be binding.<\/p>\n

(8) In its decision, Central\u00a0Information<\/span>\u00a0Commission or State\u00a0Information<\/span>\u00a0Commission, as the case may be, has the power\u00a0to<\/span>\u2014<\/p>\n

(a<\/i>) require the public authority\u00a0to<\/span>\u00a0take any such steps as may be necessary\u00a0to<\/span>\u00a0secure compliance with the provisions of this\u00a0Act<\/span>, including\u2014<\/p>\n

(i<\/i>) by providing access\u00a0to<\/span>\u00a0information<\/span>, if so requested, in a particular form;<\/p>\n

(ii<\/i>) by appointing a Central Public\u00a0Information<\/span>\u00a0Officer or State Public\u00a0Information<\/span>\u00a0Officer, as the case may be;<\/p>\n

(iii<\/i>) by publishing certain\u00a0information<\/span>\u00a0or categories of\u00a0information<\/span>;<\/p>\n

(iv<\/i>) by making necessary changes\u00a0to<\/span>\u00a0its practices in relation\u00a0to<\/span>\u00a0the maintenance, management and destruction of records;<\/p>\n

(v<\/i>) by enhancing the provision of training on the\u00a0right<\/span>\u00a0to<\/span>\u00a0information<\/span>\u00a0for its officials;<\/p>\n

(vi<\/i>) by providing it with an annual report in compliance with clause (b<\/i>) of sub-section<\/span>\u00a0(1) of\u00a0Section<\/span>\u00a04;<\/p>\n

(b<\/i>) require the public authority\u00a0to<\/span>\u00a0compensate the complainant for any loss or other detriment suffered;<\/p>\n

(c<\/i>) impose any of the penalties provided under this\u00a0Act<\/span>;<\/p>\n

(d<\/i>) reject the application.<\/p>\n

(9) The Central\u00a0Information<\/span>\u00a0Commission or State\u00a0Information<\/span>\u00a0Commission, as the case may be, shall give notice of its decision, including any\u00a0right<\/span>\u00a0of\u00a0appeal<\/span>,\u00a0to<\/span>\u00a0the complainant and the public authority.<\/p>\n

(10) The Central\u00a0Information<\/span>\u00a0Commission or State\u00a0Information<\/span>\u00a0Commission, as the case may be, shall decide the\u00a0appeal<\/span>\u00a0in accordance with such procedure as may be prescribed.<\/p>\n<\/blockquote>\n

Decision<\/span><\/p>\n

Commission observed that an appropriate reply has not been furnished to the appellant.<\/p>\n

Exemption under Section 8(1)(j) of RTI Act<\/span><\/p>\n

Further, it was noted that the exemption of Section 8(1)(j) of the RTI Act can only be claimed when the information sought relates to the personal information of a third party, the disclosure of which has no relationship to any public interest and would <\/span>cause an unwarranted invasion of the privacy of the third party.<\/span><\/p>\n

In the present matter, the bench noted that the information sought was not the personal information of a third party, hence exemption Section 8(1)(j) of the RTI Act would not be applicable in the present case.<\/span><\/p>\n

While disposing of the present appeal and considering the above-noted facts, along with the fact that RTI Act supersedes any departmental rules, the Commission directed the respondent to furnish due information to the appellant.
