{"id":235853,"date":"2020-09-16T11:09:33","date_gmt":"2020-09-16T05:39:33","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=235853"},"modified":"2020-09-16T11:09:33","modified_gmt":"2020-09-16T05:39:33","slug":"lok-sabha-essential-commodities-amendment-bill-2020-certain-food-items-can-be-regulated-by-govt-under-extraordinary-circumstances-bill-passed","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2020\/09\/16\/lok-sabha-essential-commodities-amendment-bill-2020-certain-food-items-can-be-regulated-by-govt-under-extraordinary-circumstances-bill-passed\/","title":{"rendered":"Lok Sabha | Essential Commodities (Amendment) Bill,\u00a0 2020: Certain food items can be regulated by Govt. under extraordinary circumstances [Bill Passed]"},"content":{"rendered":"<h3 style=\"text-align: center;\"><span style=\"color: #ff0000;\">The Essential Commodities (Amendment) Bill,\u00a0 2020<\/span><\/h3>\n<p><span style=\"color: #008000;\">Which Act will this bill amend?<\/span><\/p>\n<p>The Essential Commodities Act, 1955.<\/p>\n<p><span style=\"color: #008000;\">Which Sections will the said Bill amend?<\/span><\/p>\n<p>Insertion of sub-section (1 A) after sub-section (1) in Section 3.<\/p>\n<p>\u2018(1A) Notwithstanding anything contained in sub-section (1),\u2014<\/p>\n<p>(a) the supply of such foodstuffs, including cereals, pulses, potato, onions, edible oilseeds and oils, as the Central Government may, by notification in the Official Gazette, specify, may be regulated only under extraordinary circumstances which may include war, famine, extraordinary price rise and natural calamity of grave nature;<\/p>\n<p>(b) any action on imposing stock limit shall be based on price rise and an order for regulating stock limit of any agricultural produce may be issued under this Act only if there is\u2014<\/p>\n<p>(i) hundred per cent. increase in the retail price of horticultural produce; or<\/p>\n<p>(ii) fifty per cent. increase in the retail price of non-perishable agricultural foodstuffs, over the price prevailing immediately preceding twelve months, or average retail price of the last five years, whichever is lower:<\/p>\n<p>Provided that such order for regulating stock limit shall not apply to a processor or value chain participant of any agricultural produce if the stock limit of such person does not exceed the overall ceiling of installed capacity of processing, or the demand for export in case of an exporter:<\/p>\n<p>Provided further that nothing contained in this sub-section shall apply to any order, relating to the Public Distribution System or the Targeted Public Distribution System, made by the Government under this Act or under any other law for the time being in force<\/p>\n<p><span style=\"color: #008000;\"><strong>Read the detailed bill, here:<\/strong><\/span> <a href=\"http:\/\/164.100.47.4\/BillsTexts\/LSBillTexts\/Asintroduced\/111_2020_LS_Eng.pdf\">BILL<\/a><\/p>\n<h3 style=\"text-align: center;\"><span style=\"color: #0000ff;\"><strong>As per media reports, the Essential Commodities (Amendment) Bill, 2020 has been passed by Lok Sabha.<\/strong><\/span><\/h3>\n<hr \/>\n<p>Lok Sabha<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Essential Commodities (Amendment) Bill,\u00a0 2020 Which Act will this bill amend?
