HC discusses in light of stoppage of social security pension"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Andhra Pradesh High Court:\u00a0<\/strong>Battu Devanand, J., while addressing the instant matter, observed that,<\/p>\n<div class=\"page\" style=\"text-align: justify;\" title=\"Page 9\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<blockquote>\n<p style=\"text-align: justify;\"><span style=\"color: #800000;\">The government is not supposed to spend public money as per their whims and fancies as public money is accrued from the payment of the taxpayers.<\/span><\/p>\n<\/blockquote>\n<\/div>\n<\/div>\n<\/div>\n<p style=\"text-align: justify;\"><span style=\"color: #333399;\">Discontinuation of Pensions<\/span><\/p>\n<p style=\"text-align: justify;\">175 Petitioners filed the petition seeking direction declaring the action of respondents in discontinuing pensions to them as illegal, arbitrary, discriminatory and against the rules governing the distribution of pensions and direct all the respondents to distribute arrears of pension to the petitioners and continue to pay them thereafter.<\/p>\n<p style=\"text-align: justify;\">Another petitioner consisting of 5 petitioners filed the petition against the respondent&#8217;s action to stop old aged\/widow pensions.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #800080;\">Decision<\/span><\/p>\n<p style=\"text-align: justify;\">The Government of Andhra Pradesh vide its order said that the Government of Andhra Pradesh is implementing <span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">various pension schemes as part of its welfare programmes for most needy and vulnerable people i.e., the persons in old age, widows, people with disabilities and weavers to provide them some succor.<\/span><\/p>\n<p style=\"text-align: justify;\">Court stated that on perusal of the Government Order, it is clear that as part of welfare programmes the Government <span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">is implementing various social security pension schemes for the benefit of needy and vulnerable sections of the people to provide them some succor.<\/span><\/p>\n<div class=\"page\" title=\"Page 9\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<blockquote>\n<p style=\"text-align: justify;\"><span style=\"color: #993300;\">&#8220;&#8230;attempt of the government to implement these \u201cSocial security pension schemes\u201d to provide the people belong to vulnerable sections to provide some succor is undoubtedly laudable.&#8221;<\/span><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">Bench emphasized the fact that the Government is the trustee of public money and is empowered to utilize the public money <span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">in a proper manner for the benefit of the public at large.<\/span><\/p>\n<p style=\"text-align: justify;\">Supreme Court&#8217;s decision in <em><span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">Ramana Dayaram Shetty v. International Airport Authority of India, <\/span><\/em><a href=\"http:\/\/www.scconline.com\/DocumentLink\/n2yQJcyr\"><span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">(<\/span><span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">1979) 3 SCC 489<\/span><\/a><span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\"> was also referred, wherein the following was held:<\/span><\/p>\n<div class=\"page\" title=\"Page 10\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<blockquote>\n<p style=\"text-align: justify;\"><span style=\"color: #008000;\">\u201cThe discretion of the government has been held to be not unlimited in that the government cannot give or withhold largess in its arbitrary discretion or at its sweet will.&#8221;<\/span><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\"><strong>Public Money<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">Further, the High Court also noted the fact that earlier crores of public money was spent on different activities in the State of Andhra Pradesh.<\/p>\n<p style=\"text-align: justify;\">In view of the above Court stated that,<\/p>\n<p style=\"text-align: justify;\"><em>Did any person in the State ask the State Government to spend a thousand crores of rupees for organising &#8220;Godavari and Krishna Pushkaralu&#8221;?\u00a0<\/em><\/p>\n<div class=\"page\" title=\"Page 13\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p style=\"text-align: justify;\"><em>Did any Christian ask for \u201cCHRISTMAS KANUKALU ?\u201d<\/em><\/p>\n<p style=\"text-align: justify;\"><em>Did any Muslim request for \u201cRAMJAN THOFA?\u201d<\/em><\/p>\n<p style=\"text-align: justify;\">At present, thousands of crores of rupees are being sent under various pogrammes <span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">stating that it is for the welfare of the people.\u00a0<\/span><\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><span style=\"color: #993300;\">One has to question himself whether the public money is being utilized properly as it seems to be.<\/span><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">Unreasonable to stop payment of meager amount<\/span><\/p>\n<p style=\"text-align: justify;\">Hence, the Bench held that <span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">Court is of the opinion that while spending crores of rupees of public money for all the programmes as stated above, it is unreasonable to stop payment of meager amount being paid towards social security pension in favour of the petitioners.<\/span><\/p>\n<p style=\"text-align: justify;\">Court to fortify its view cited the Supreme Court decision in,\u00a0<em>Raghunath Thakur v. State of Bihar,\u00a0<\/em><a href=\"http:\/\/www.scconline.com\/DocumentLink\/rq3EVEao\">(1989) 1 SCC 229<\/a>, wherein the following was held:<\/p>\n<div class=\"page\" title=\"Page 18\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p style=\"text-align: justify;\">&#8220;&#8230;a person adversely affected by order has right of being heard and making representations against order, even though rules do not provide so expressly\u201d.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">Social Security<\/span><\/p>\n<p style=\"text-align: justify;\">Concluding with its&#8217; analysis, Court held that stopping payment of social security to the petitioners without conducting any enquiry or without issuing any notice is illegal, arbitrary, discriminatory and against the object of the social security pension scheme and against the principles of natural justice.<\/p>\n<p style=\"text-align: justify;\">Two directions have been passed by the Bench in the above petitions:<\/p>\n<div class=\"page\" title=\"Page 19\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<ul style=\"text-align: justify;\">\n<li>Respondents are directed to make payment of pension to the petitioners from the month when it was stopped to till date within a period of 15 days.<\/li>\n<li>Respondents are directed to continue the payment of the pension every month.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">[Seepana Govindamma v.
