Narcotics Control Bureau (NCB) had sought 14 days Judicial Custody of Actress Rhea Chakraborty for being involved in the procurement and distribution of Drugs.<\/p>\n

According to the media reports, She has been allegedly charged for Sections 8(c), 20(b) (ii), 22, 27(A), 28 and 29 of the Narcotic Drugs and\u00a0Psychotropic Substances Act, 1985<\/p>\n

Her Bail plea was also rejected.<\/p>\n

Rhea was summoned and her voluntary statement was recorded under Section 67 of NDPS Act on 06-09-2020, 07-09-2020 and 08-09-2020.<\/p>\n

NCB states that Rhea is an active member of the drug syndicate connected with drug supplies.<\/p>\n

\n

Here’s an explainer for the Sections under which Rhea Chakraborty has been charged:<\/span><\/strong><\/p>\n

Section 8(c) of the NDPS Act:<\/a><\/p>\n

8<\/span>.\u00a0Prohibition<\/span>\u00a0of<\/span>\u00a0certain<\/span>\u00a0operations<\/span><\/b>.\u2014No person shall\u2014<\/p>\n

(a<\/i>) cultivate any coca plant or gather any portion\u00a0of<\/span>\u00a0coca plant; or<\/p>\n

(b<\/i>) cultivate the opium poppy or any cannabis plant; or<\/p>\n

(c<\/i>) produce, manufacture, possess, sell, purchase, transport, warehouse, use, consume, import inter-State, export inter-State, import into India, export from India or tranship any\u00a0narcotic<\/span>\u00a0drug or\u00a0psychotropic<\/span>\u00a0substance,<\/span><\/p>\n

except for medical or scientific purposes\u00a0and<\/span>\u00a0in the manner\u00a0and<\/span>\u00a0to the extent provided by the provisions\u00a0of<\/span>\u00a0this\u00a0Act<\/span>\u00a0or the rules or orders made thereunder\u00a0and<\/span>\u00a0in a case where any such provision, imposes any requirement by way\u00a0of<\/span>\u00a0licence, permit or authorisation also in accordance with the terms\u00a0and<\/span>\u00a0conditions\u00a0of<\/span>\u00a0such licence, permit or authorisation:<\/p>\n

Provided that,\u00a0and<\/span>\u00a0subject to the other provisions\u00a0of<\/span>\u00a0this\u00a0Act<\/span>\u00a0and<\/span>\u00a0the rules made thereunder, the\u00a0prohibition<\/span>\u00a0against the cultivation\u00a0of<\/span>\u00a0the cannabis plant for the production\u00a0of<\/span>\u00a0ganja<\/i>\u00a0or the production, possession, use, consumption, purchase, sale, transport, warehousing, import inter-State\u00a0and<\/span>\u00a0export inter-State\u00a0of<\/span>\u00a0ganja<\/i>\u00a0for any purpose other than medical\u00a0and<\/span>\u00a0scientific purpose shall take effect only from the date which the Central Government may, by notification in the Official Gazette, specify in this behalf.<\/p>\n

1<\/a><\/sup>[Provided further that nothing in this\u00a0section<\/span>\u00a0shall apply to the export\u00a0of<\/span>\u00a0poppy straw for decorative purposes.]<\/p>\n

Section 20(b) (ii) of NDPS Act, 1985:<\/a><\/p>\n

Punishment<\/span>\u00a0for<\/span>\u00a0contravention<\/span>\u00a0in<\/span>\u00a0relation<\/span>\u00a0to<\/span>\u00a0cannabis<\/span>\u00a0plant<\/span>\u00a0and<\/span>\u00a0cannabis<\/span>.<\/b>\u2014Whoever,\u00a0in<\/span>\u00a0contravention<\/span>\u00a0of any provision of this\u00a0Act<\/span>\u00a0or any rule or order made or condition of licence granted thereunder,\u2014<\/p>\n

(a<\/i>) cultivates any\u00a0cannabis<\/span>\u00a0plant<\/span>; or<\/p>\n

(b<\/i>) produces, manufactures, possesses, sells, purchases, transports, imports inter-State, exports inter-State or uses\u00a0cannabis<\/span>, shall be punishable,\u2014<\/span><\/p>\n

1<\/a><\/sup>[(i<\/i>) where such\u00a0contravention<\/span>\u00a0relates\u00a0to<\/span>\u00a0clause (a<\/i>) with rigorous imprisonment\u00a0for<\/span>\u00a0a term which may extend\u00a0to<\/span>\u00a0ten years,\u00a0and<\/span>\u00a0shall also be liable\u00a0to<\/span>\u00a0fine which may extend\u00a0to<\/span>\u00a0one lakh rupees;\u00a0and<\/span><\/span><\/p>\n

(ii<\/i>) where such\u00a0contravention<\/span>\u00a0relates\u00a0to<\/span>\u00a0clause (b<\/i>),\u2014<\/span><\/p>\n

(A<\/i>)\u00a0and<\/span>\u00a0involves small quantity, with rigorous imprisonment\u00a0for<\/span>\u00a0a term which may extend\u00a0to<\/span>\u00a02<\/a><\/sup>[one year], or with fine which may extend\u00a0to<\/span>\u00a0ten thousand rupees, or with both;<\/span><\/p>\n

(B<\/i>)\u00a0and<\/span>\u00a0involves quantity lesser than commercial quantity but greater than small quantity, with rigorous imprisonment\u00a0for<\/span>\u00a0a term which may extend\u00a0to<\/span>\u00a0ten years,\u00a0and<\/span>\u00a0with fine which may extend\u00a0to<\/span>\u00a0one lakh rupees;<\/span><\/p>\n

(C<\/i>)\u00a0and<\/span>\u00a0involves commercial quantity, with rigorous imprisonment\u00a0for<\/span>\u00a0a term which shall not be less than ten years but which may extend\u00a0to<\/span>\u00a0twenty years\u00a0and<\/span>\u00a0shall also be liable\u00a0to<\/span>\u00a0fine which shall not be less than one lakh rupees but which may extend\u00a0to<\/span>\u00a0two lakh rupees:<\/span><\/p>\n

Provided that the court may,\u00a0for<\/span>\u00a0reasons\u00a0to<\/span>\u00a0be recorded\u00a0in<\/span>\u00a0the judgment, impose a fine exceeding two lakh rupees.]<\/span><\/p>\n

Section 27(A) of the NDPS Act:<\/a><\/p>\n

Punishment<\/span>\u00a0for<\/span>\u00a0financing<\/span>\u00a0illicit<\/span>\u00a0traffic<\/span>\u00a0and<\/span>\u00a0harbouring<\/span>\u00a0offenders<\/span><\/b>.\u2014Whoever indulges in\u00a0financing<\/span>, directly or indirectly, any of the activities specified in sub-clauses (i<\/i>) to (v<\/i>) of clause (viii-a<\/span><\/i>) of\u00a0Section<\/span>\u00a02 or harbours any person engaged in any of the aforementioned activities, shall be punishable with rigorous imprisonment\u00a0for<\/span>\u00a0a<\/span>\u00a0term which shall not be less than ten years but which may extend to twenty years\u00a0and<\/span>\u00a0shall also be liable to fine which shall not be less than one lakh rupees but which may extend to two lakh rupees:<\/p>\n

Provided that the court may,\u00a0for<\/span>\u00a0reasons to be recorded in the judgment, impose\u00a0a<\/span>\u00a0fine exceeding two lakh rupees.]<\/p>\n

Section 29 of the NDPS Act:<\/a><\/p>\n

29<\/span>.\u00a0Punishment<\/span>\u00a0for<\/span>\u00a0abetment<\/span>\u00a0and<\/span>\u00a0criminal<\/span>\u00a0conspiracy<\/span>.<\/b>\u2014(1) Whoever abets, or is a party to a\u00a0criminal<\/span>\u00a0conspiracy<\/span>\u00a0to commit, an offence punishable under this Chapter, shall, whether such offence be or be not committed in consequence of such\u00a0abetment<\/span>\u00a0or in pursuance of such\u00a0criminal<\/span>\u00a0conspiracy<\/span>,\u00a0and<\/span>\u00a0notwithstanding anything contained in\u00a0Section<\/span>\u00a0116 of the Indian Penal Code (45 of 1860), be punishable with the\u00a0punishment<\/span>\u00a0provided\u00a0for<\/span>\u00a0the offence.<\/p>\n

(2) A person abets, or is a party to a\u00a0criminal<\/span>\u00a0conspiracy<\/span>\u00a0to commit, an offence, within the meaning of this\u00a0section<\/span>, who, in India, abets or is a party to the\u00a0criminal<\/span>\u00a0conspiracy<\/span>\u00a0to the commission of any\u00a0act<\/span>\u00a0in a place without\u00a0and<\/span>\u00a0beyond India which\u2014<\/p>\n

(a<\/i>) would constitute an offence if committed within India; or<\/p>\n

(b<\/i>) under the laws of such place, is an offence relating to\u00a0narcotic<\/span>\u00a0drugs<\/span>\u00a0or\u00a0psychotropic<\/span>\u00a0substances<\/span>\u00a0having all the legal conditions required to constitute it such an offence the same as or analogous to the legal conditions required to constitute it an offence punishable under this Chapter, if committed within India.<\/p>\n
