RGNUL Financial and Mercantile Law Review (RFMLR)<\/strong>\u00a0is a bi-annual, double-blind peer-reviewed law journal published by\u00a0the Rajiv Gandhi National University of Law, Punjab. The journal was first published in the year 2014 and gives an opportunity to the legal academia, legal professionals, and law students to contribute cutting-edge, doctrinal, theoretical, and empirical research in the field of business and commercial laws.\u00a0The journal is indexed on SCC Online and has been consistently ranked amongst the ten most accessed law school journals by SCC Online. In order to create awareness and advance the discourse on Fintech Law,\u00a0the Editorial Board of RFMLR\u00a0is organizing\u00a0RFMLR TechTalk: A\u00a0Webinar Series on Digital Commerce and Fintech Law<\/em>,\u00a0wherein experts in this field would discuss\u00a0topics like open-banking, smart contracts, neo-banking, digital payments, blockchain, cryptocurrency, e-commerce, and so forth.\u00a0In furtherance of RFMLR’s\u00a0Call for Blogs on Digital Commerce and Fintech<\/a>, Techtalk is an initiative to provide our readers with greater exposure to this field of law.<\/p>\n

About the Resource Persons<\/strong><\/p>\n

Ms Akshata Namjoshi\u00a0<\/strong>is the Lead (Fintech, Blockchain, and Emerging Tech) at KARM Legal Consultants, UAE.\u00a0She pursued her\u00a0B.A. LL.B. (Hons.) from the National Law Institute University (NLIU), Bhopal and further completed her LL.M. (Corporate and Financial Services Law) from the National University of Singapore (NUS).\u00a0She has worked at leading law firms in India and UAE. She has\u00a0worked as an Associate at Shardul Amarchand Mangaldas.<\/p>\n

Ms Namjoshi is currently a\u00a0member of the Regulatory Fintech Working Group of the Arab Monetary Fund. She has been a panelist for a number of national and international conferences, like the World Blockchain STO Summit, Dubai, and Roundtable Discussion on DLT, Blockchain and Law at the Legal Technology Event.\u00a0She has advised high net-worth individuals and corporates on\u00a0Security Token Offerings,\u00a0setting up of cryptocurrency exchanges, deployment of public and enterprise blockchains, and so on.<\/p>\n

Mr Ratul Roshan<\/strong>\u00a0is an Associate at Ikigai Law with expertise in Blockchain Technology, Fintech, and Tech Policy.\u00a0He pursued his LL.B. from Delhi University. He has authored a number of articles on blockchain, cryptocurrency, fintech, and data protection and has worked on projects related to crypto regulations and blockchain technology in India.<\/p>\n

He advises cloud service providers, online content platforms, financial technology companies, and e-commerce platforms on laws governing personal and non-personal data, privacy, content regulation, intermediary liability, and cloud infrastructure ownership, amongst other laws.<\/p>\n

About the Sessions<\/strong><\/p>\n

Ms Namjoshi will be discussing the legal landscape of\u00a0Open Banking and Open Finance<\/strong>. She would discuss how banking and other financial data is shared between independent parties to provide enhanced capabilities to the financial market. She would also be covering the privacy and financial security issues associated with Open Banking and Open Finance. She will highlight the role of account information service providers, payment initiation service providers, and Digital IDs in Open Banking and Open Finance. She will be giving some practical examples of Open Banking from the\u00a0Middle East.<\/p>\n

Mr Roshan will be dealing with\u00a0Smart Contracts and their Enforceability<\/strong>. He will be explaining the concept of smart contracts and the technology behind them. He will be discussing whether smart contracts are contracts at all and whether we need a separate law for them. He will discuss the enforceability of smart contracts and the purported hurdles in using smart legal contracts while proposing solutions for the same.<\/p>\n
