Court restates legal position"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Allahabad High Court:\u00a0<\/strong>Dr Kaushal Jayendra Thaker, J., decided upon the prayer of protection being sought by a boy and girl living together on their own free will as husband and wife with threats and harassment.<\/p>\n<p style=\"text-align: justify;\">The present matter is in regard to seek a direction upon the respondents to not interfere in the petitioner&#8217;s married life and the protection of their lives has also been sought.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000080;\">Serious Danger to Life<\/span><\/p>\n<p style=\"text-align: justify;\">Petitioners claimed that they are adults and living together on their own free will, though they are being threatened and harassed by the private respondent and his other family members.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000080;\">Family Honour<\/span><\/p>\n<p style=\"text-align: justify;\">Further, the petitioners added that they are living as husband and wife and have apprehension that private respondent can eliminate them for the honour of his family.<\/p>\n<p style=\"text-align: justify;\">They seek protection as their lives may be endangered.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000080;\">Decision<\/span><\/p>\n<p style=\"text-align: justify;\">Bench stated that the present petition is to be disposed of in terms of the Rules of the Court.<\/p>\n<p style=\"text-align: justify;\">Court referred to the decisions of the Supreme Court in <span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\"><em>Gian Devi v. Superintendent, Nari Niketan<\/em>, Delhi, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/RdUCxEPb\">(1976) 3 SCC 234<\/a>; <em>Lata Singh v. State of U.P.<\/em>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/xgj4ZTce\">(2006) 5 SCC 475<\/a>; and <em>Bhagwan Dass v. State (NCT of Delhi)<\/em>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/6L545dq4\">(2011) 6 SCC 396<\/a> and observed that the law has been settled by the Supreme Court that,<\/span><\/p>\n<blockquote>\n<div class=\"page\" title=\"Page 1\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p style=\"text-align: justify;\">&#8220;&#8230;where a boy and a girl are major and they are living with their free will, then, nobody including their parents, has authority to interfere with their living together.&#8221;<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/blockquote>\n<div class=\"page\" title=\"Page 1\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p style=\"text-align: justify;\">Therefore, petitioners are at liberty to live together and no person shall be permitted to interfere in their peaceful living.<\/p>\n<p style=\"text-align: justify;\">Petitioners shall approach the police authority concerned in case of any disturbance of their peaceful living.<\/p>\n<p style=\"text-align: justify;\">In view of the above, the petition was disposed of.
