{"id":233459,"date":"2020-08-06T11:35:42","date_gmt":"2020-08-06T06:05:42","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=233459"},"modified":"2020-08-14T12:03:20","modified_gmt":"2020-08-14T06:33:20","slug":"cal-hc-press-reporter-has-a-fundamental-right-to-publish-any-news-which-may-not-be-palatable-to-administration","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2020\/08\/06\/cal-hc-press-reporter-has-a-fundamental-right-to-publish-any-news-which-may-not-be-palatable-to-administration\/","title":{"rendered":"Cal HC | Press Reporter has a fundamental right to publish any news, which may not be palatable to administration"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Calcutta High Court:\u00a0<\/strong>A Division Bench of Bibek Chaudhari and Soumen Sen, JJ., addressed a matter wherein a reporter published a story on witnessing the police personnel bribing a truck driver and further driving negligent get hold of the truck resulting in the death of a person.<\/p>\n<p style=\"text-align: justify;\">Petitioner a reporter of ETV Bharat made a news report stating, inter alia that some police personnel was collecting bribe from a truck loaded with sand and while chasing the truck, the vehicle owned by the police department was being driven in a rash and negligent manner.<\/p>\n<p style=\"text-align: justify;\">The result of the rash and negligent driving caused the death of a person.<\/p>\n<p style=\"text-align: justify;\">Above was the prima facie reason for lodging a complaint against the petitioner.<\/p>\n<p style=\"text-align: justify;\">Bench on perusal of the materials on record stated that, it is a fundamental right of a press reporter to publish any news, which may not be palatable to the administration.<\/p>\n<div class=\"page\" title=\"Page 2\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<blockquote>\n<p style=\"text-align: justify;\"><span style=\"color: #800000;\">In order to stifle and muzzle the voice of the reporter this case has been registered against the petitioner.<\/span><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">Court also noted the fact that the police have taken cognizance of the report which prima facie discloses the offences committed by its own personnel.<\/p>\n<p style=\"text-align: justify;\">Hence, in view of the above, Police Superintendent of the District concerned has been directed to initiate <span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">enquiry regarding registration of the FIR against the ETV reporter and to investigate about the collection of money by the police personnel, the incident of which has been published by the reporter and to take appropriate action against the offenders.<\/span><\/p>\n<p style=\"text-align: justify;\">Therefore, the petitioner shall be released on bail.
