{"id":231997,"date":"2020-07-09T16:02:40","date_gmt":"2020-07-09T10:32:40","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=231997"},"modified":"2020-07-17T14:07:11","modified_gmt":"2020-07-17T08:37:11","slug":"ker-hc-if-consent-given-out-of-love-and-passion-on-a-promise-of-marriage-sexual-intercourse-is-not-rape-court-while-granting-pre-arrest-bail-to-rape-accused","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2020\/07\/09\/ker-hc-if-consent-given-out-of-love-and-passion-on-a-promise-of-marriage-sexual-intercourse-is-not-rape-court-while-granting-pre-arrest-bail-to-rape-accused\/","title":{"rendered":"Ker HC | If consent given out of love and passion on a promise of marriage, sexual intercourse is not rape: Court while granting pre-arrest bail to rape accused"},"content":{"rendered":"<div class=\"gmail_quote\" dir=\"auto\">\n<div dir=\"ltr\">\n<p style=\"text-align: justify;\"><strong>Kerala High Court:\u00a0<\/strong>Raja Vijayaraghavan V, J., allowed pre-arrest bail to the applicant accused of raping a women whom he allegedly met on facebook.<\/p>\n<\/div>\n<\/div>\n<p style=\"text-align: justify;\">Accused preferred a pre-arrest bail application for offence punishable under Section 376(1) of the Penal Code, 1860.<\/p>\n<p style=\"text-align: justify;\">Petitioner and informant were in a relationship for 1.5 years and petitioner had promised to marry the informant.<\/p>\n<p style=\"text-align: justify;\">When informant had reached Kozikhode for purchasing some clothes for their marriage, she was taken to a lodge, where both petitioner and informant stayed together and informant was subjected to penetrative sexual abuse.<\/p>\n<p style=\"text-align: justify;\">Petitioner also took some pictures of the informant and threatened with the same to obtain a sum of Rs 40,000 and gold chain.<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #0000ff;\">Decision<\/span><\/h3>\n<p style=\"text-align: justify;\">Bench noted that according to the de facto complainant, she was in a relationship with the petitioner.<\/p>\n<p style=\"text-align: justify;\">Court relied on the Supreme Court case of <span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\"><em>Dr Dhruvaram Muralidhar Sonar v. State of Maharashtra<\/em> [2019 (1) KHC 403] wherein it was held that there is a distinction between rape and consensual sex.<\/span><\/p>\n<p style=\"text-align: justify;\">Bench stated in the present matter that the question to be considered is:<\/p>\n<blockquote>\n<div class=\"page\" title=\"Page 4\">\n<div class=\"section\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p style=\"text-align: justify;\">Whether the accused had actually wanted to marry the victim or had mala fide motives and had made a false promise to that effect only to satisfy his lust?<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/blockquote>\n<div class=\"page\" title=\"Page 4\">\n<div class=\"section\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<div class=\"page\" title=\"Page 4\">\n<div class=\"section\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<blockquote>\n<p style=\"text-align: justify;\"><span style=\"color: #ff0000;\">&#8220;&#8230;former is not rape but the latter will fall within the ambit of cheating and deception.&#8221;<\/span><\/p>\n<\/blockquote>\n<div class=\"page\" style=\"text-align: justify;\" title=\"Page 4\">\n<div class=\"section\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<h3><span style=\"color: #0000ff;\">Distinction between mere breach of a promise and not fulfilling a false promise<\/span><\/h3>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p style=\"text-align: justify;\">Further Court also observed that,<\/p>\n<div class=\"page\" title=\"Page 5\">\n<div class=\"section\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p style=\"text-align: justify;\">if the consent given by the prosecutrix to sexual intercourse with a person with whom she is deeply in love on a promise that he would marry her on a later date, then such consent cannot be said to be given under a misconception of fact.<\/p>\n<p style=\"text-align: justify;\">Thus, in view of the above, Court&#8217;s opinion was that the custodial interrogation of the petitioner was not necessitous for an effective investigation.<\/p>\n<p style=\"text-align: justify;\">Hence, the present application was allowed with certain conditions.
