{"id":231971,"date":"2020-07-09T10:55:47","date_gmt":"2020-07-09T05:25:47","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=231971"},"modified":"2020-07-09T11:04:10","modified_gmt":"2020-07-09T05:34:10","slug":"ban-imposed-by-karnataka-government-on-conduct-of-online-classes-infringes-the-fundamental-rights-of-the-children-guaranteed-under-arts-21-and-21a-of-the-constitution","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2020\/07\/09\/ban-imposed-by-karnataka-government-on-conduct-of-online-classes-infringes-the-fundamental-rights-of-the-children-guaranteed-under-arts-21-and-21a-of-the-constitution\/","title":{"rendered":"Kar HC | Ban imposed by Karnataka Govt on conduct of online classes infringes Fundamental Rights of the children guaranteed under Arts. 21 and 21A of Constitution"},"content":{"rendered":"<p class=\"p1\" style=\"text-align: justify;\"><span class=\"s1\"><b>Karnataka High Court: <\/b>While deliberating upon the Government Orders issued by the State of Karnataka wherein restrictions\/ ban was imposed on conduct of online classes by schools, the Division Bench of Abhay Srinivas Oka, CJ, and Nataraj Rangaswamy, J., expressing a prima facie view, held that the ban imposed by the State Government on the conduct of online classes infringes the Fundamental Rights of the children and therefore is violative of Arts. 21 and 21A of the Constitution. <\/span><\/p>\n<p class=\"p1\" style=\"text-align: justify;\"><span class=\"s1\">The State Government had issued the impugned Orders on 15-06-2020 and 27-06-2020 via which they had imposed a ban on\u00a0online classes\u00a0from pre-school to Class 5<\/span><span class=\"s2\"><sup>th<\/sup><\/span><span class=\"s1\"> and from Class 1<\/span><span class=\"s2\"><sup>st<\/sup><\/span><span class=\"s1\"> to Class 10<\/span><span class=\"s2\"><sup>th<\/sup><\/span><span class=\"s1\"> respectively. Furthermore, the Court passed an interim direction thereby putting a stay on the impugned Orders. However, the Bench deemed it fit to clarify that the private schools should not interpret this decision as way to make online classes compulsory and collect extra fees for the same. Furthermore, those children who do not opt for online classes should not be deprived of coaching when the normal functioning of schools resume.<\/span><\/p>\n<hr \/>\n<p class=\"p2\"
