{"id":231175,"date":"2020-06-20T16:06:29","date_gmt":"2020-06-20T10:36:29","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=231175"},"modified":"2020-06-26T12:04:48","modified_gmt":"2020-06-26T06:34:48","slug":"blacklivesmatter-del-hc-commissioner-of-police-to-decide-whether-peace-protest-and-demonstration-can-be-held-outside-uttar-pradesh-bhawan-for-black-lives-matter","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2020\/06\/20\/blacklivesmatter-del-hc-commissioner-of-police-to-decide-whether-peace-protest-and-demonstration-can-be-held-outside-uttar-pradesh-bhawan-for-black-lives-matter\/","title":{"rendered":"#BlackLivesMatter | Del HC | Commissioner of Police to decide: Whether peace protest and demonstration can be held outside Uttar Pradesh Bhawan for &#8220;Black Lives Matter&#8221;"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Delhi High Court:\u00a0<\/strong>Navin Chawla, J., held that Police Commissioner to decide whether peace protest and demonstration under the banner of IPOB and #Black Lives Matter, at Uttar Pradesh Bhawan building can be held or not.<\/p>\n<p style=\"text-align: justify;\">Present Petition was filed inter-alia praying for the following reliefs:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Direct respondents to allow the petitioner to hold police peace protest and demonstration under the banner of IPOB and #Black Lives Matter, at Uttar Pradesh Bhawan building\u00a0 on 23rd June, 2020or any date immediately thereafter against the illegal detention of the two members of the IPOB<\/li>\n<li>Direct respondent 2 to allow peaceful protest and demonstration at Uttar Pradesh Bhawan and make appropriate arrangement for the participants and allow relatives and advocates of illegally detained members of IPOB to meet them.<\/li>\n<li>Direct respondents to produce before the Court all documents related to illegal detention of two members of IPOB.<\/li>\n<li>Pass an order Directing the respondent Delhi Police as well as MHA to take appropriate Decision allowing the Peaceful protest.<\/li>\n<\/ul>\n<div class=\"page\" title=\"Page 3\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p style=\"text-align: justify;\">With regard to illegal detention of two IPOB members, Court stated that it does not have the territorial jurisdiction to entertain such prayers.<\/p>\n<p style=\"text-align: justify;\">With regard to peaceful protest, respondent 1 is directed to consider the contents of the petition as a representation of petitioner for seeking permission for the said purpose. Within 3 days a decision shall be communicated to the person concerned.<\/p>\n<p style=\"text-align: justify;\">In view of the above terms, petition was disposed of.
