{"id":229251,"date":"2020-05-08T17:51:37","date_gmt":"2020-05-08T12:21:37","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=229251"},"modified":"2020-06-13T11:38:17","modified_gmt":"2020-06-13T06:08:17","slug":"breaking-vizag-gas-leak-incident-ngt-leakage-of-hazardous-gas-at-such-a-scale-affects-public-health-lg","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2020\/05\/08\/breaking-vizag-gas-leak-incident-ngt-leakage-of-hazardous-gas-at-such-a-scale-affects-public-health-lg\/","title":{"rendered":"[Breaking] Vizag Gas Leak Incident | NGT |Leakage of hazardous gas at such a scale affects public health &#038; environment, attracts principle of \u2018Strict Liability\u2019 against enterprise; LG Polymers directed to deposit Rs 50 Crore"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>National Green Tribunal (NGT), New Delhi:\u00a0<\/strong>Bench comprising\u00a0 of Justice Adarsh Kumar Goel (Chairperson) and Justice Sheo Kumar Singh, Judicial Member and Nagin Nanda, Expert Member took suo moto cognizance of Vizag Gas Leak incident.<\/p>\n<p style=\"text-align: justify;\">Tribunal noted that on the basis of media reports that there was leakage of hazardous gas, Styrene from a chemical factory owned by LG Polymers India Private Limited and it resulted in <span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">death of 11 persons and hospitalization of more than 100 people of whom at least 25 were reported to be serious.<\/span><\/p>\n<div class=\"page\" title=\"Page 1\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p style=\"text-align: justify;\">More than 1000 persons are reported sick. This particular incident damaged the environment and habitat as well.<\/p>\n<p style=\"text-align: justify;\">Thus the said media reports gave rise to substantial question of environment, that need to be gone into by the Tribunal under Sections 14 and 15 of NGT Act, 2010.<\/p>\n<div class=\"page\" title=\"Page 2\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<blockquote>\n<p style=\"text-align: justify;\"><span style=\"color: #ff0000;\">Styrene gas is a hazardous chemical as defined under Rule 2(e) read with Entry 583 of Schedule I to the Manufacture, Storage and Import of Hazardous Chemical Rules, 1989.<\/span><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\"><span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">It is to be observed that, leakage of hazardous gas at such a scale adversely affecting public health and environment, clearly attracts the principle of \u2018<strong>Strict Liability\u2019<\/strong> against the enterprise engaged in hazardous or inherently dangerous industry.<\/span><\/p>\n<p style=\"text-align: justify;\">Tribunal also stated that,<\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif; color: #ff0000;\">Without prejudice to any other proceedings, this Tribunal has to perform its statutory obligation of providing relief and compensation to the victims of \u201cenvironmental damage\u201d, as statutorily enacted, and restitution of damaged property and environment.<\/span><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">Thus in view of the above, notice is issued to <span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">Andhra Pradesh State PCB, District Magistrate, Vishakhapatnam, Central Pollution Control Board (CPCB), Ministry of Environment, Forests &amp; Climate Change (MoEF&amp;CC) and LG Polymers India Private, Limited.<\/span><\/p>\n<p style=\"text-align: justify;\">A 5-Member committee is also constituted by the tribunal to seek report on the same issue.<\/p>\n<p style=\"text-align: justify;\">Further, L<span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">G Polymers India Private Limited is directed to deposit an initial amount of Rs 50 Crore with District Magistrate, Visakhapatnam.<\/span><\/p>\n<p style=\"text-align: justify;\">Matter to be listed on 18-05-2020.
