{"id":226017,"date":"2020-02-21T19:00:24","date_gmt":"2020-02-21T13:30:24","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=226017"},"modified":"2020-02-21T17:50:14","modified_gmt":"2020-02-21T12:20:14","slug":"cabinet-approves-updating-european-union-alternative-investment-fund-managers-directive-mou-signed-between-sebi-and-financial-conduct-authority-uk","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2020\/02\/21\/cabinet-approves-updating-european-union-alternative-investment-fund-managers-directive-mou-signed-between-sebi-and-financial-conduct-authority-uk\/","title":{"rendered":"Cabinet approves &#8212; Updating EU Alternative Investment Fund Managers Directive MoU signed between SEBI and Financial Conduct Authority, UK"},"content":{"rendered":"<p style=\"text-align: justify;\">The <span style=\"color: #008000;\">Union Cabinet has approved the proposal of the Securities &amp; Exchange Board of India (SEBI) to sign an updated Alternative Investment Fund Managers Directive (AIFMD) MoU signed between SEBI and Financial Conduct Authority (FCA), UK, pursuant to UK&#8217;s exit from the European Union on 31-01-2020.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\"><strong>Major impact<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">The UK exited the EU on 31<sup>st<\/sup>\u00a0January 2020. FCA, UK had submitted to SEBI that no transitional measures would be available if the amended MoU is not signed before the date when the UK exits the European Union (Brexit), and requested SEBI to sign an updated MoU as early as possible. As such, the proposal is not expected or intended to have any effect on employment in India.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\"><strong>Background<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">In accordance with the requirement of establishing adequate supervisory cooperation arrangements between EU and non-EU authorities under the European Union Alternative Investment Fund Managers Directive (AIFMD), a bilateral MoU was signed by SEBI with securities regulators of 27 member States of EU \/ European Economic Area, including Financial Conduct Authority (FCA), United Kingdom on 28<sup>th<\/sup> July 2014. In the context of UK&#8217;s proposed withdrawal from EU, FCA brought to the notice of SEBI that the existing MoU between SEBI and FCA relating to AIFMD, which is currently anchored on EU law, will no longer apply directly in the UK, and have, therefore, suggested signing an updated MoU after amending the AIFMD MoU by suitably modifying it and substituting references to EU legislation with the relevant UK law.<\/p>\n<hr \/>\n<p><strong>Cabinet<\/strong><\/p>\n<p style=\"text-align: right;\">[Press Release dt. 19-02-2020]<\/p>\n<p style=\"text-align: right;\">[Source: PIB]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Union Cabinet has approved the proposal of the Securities &amp;
