{"id":222835,"date":"2019-12-04T16:30:32","date_gmt":"2019-12-04T11:00:32","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=222835"},"modified":"2019-12-04T15:02:25","modified_gmt":"2019-12-04T09:32:25","slug":"cabinet-approves-citizenship-amendment-bill-2019","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2019\/12\/04\/cabinet-approves-citizenship-amendment-bill-2019\/","title":{"rendered":"Cabinet approves &#8212; Citizenship (Amendment) Bill, 2019"},"content":{"rendered":"<p style=\"text-align: justify;\">As per the reports of ANI, the<strong> Citizenship Amendment Bill, 2019 has been approved by the Union Cabinet.<\/strong><\/p>\n<p style=\"text-align: justify;\">It is said that it will be introduced in the Winter Session of Parliament.<\/p>\n<p style=\"text-align: justify;\">Provisions that would be introduced for further discussion in the Parliament and have been incorporated in the bill are as follows:<\/p>\n<ul style=\"text-align: justify;\">\n<li>In the Citizenship Act, 1955 (hereinafter referred to as the principal Act), in section 2, in sub-section (1), after clause (b), the following provisos shall be inserted, namely:\u2014<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">\u201cProvided that persons belonging to minority communities, namely, Hindus, Sikhs, Buddhists, Jains, Parsis and Christians from Afghanistan, Bangladesh and Pakistan, who have been exempted by the Central Government by or under clause (c) of sub- section (2) of section 3 of the Passport (Entry into India) Act, 1920 or from the application of the provisions of the Foreigners Act, 1946 or any order made thereunder, shall not be treated as illegal migrants for the purposes of that Act:<\/p>\n<p style=\"text-align: justify;\">Provided further that on and from the date of commencement of the Citizenship (Amendment) Act, 2019, any proceeding pending against any person referred to in the first proviso shall be abated and such person shall be eligible to apply for naturalisation under Section 6.\u201d<\/p>\n<ul style=\"text-align: justify;\">\n<li>In the principal Act, in <strong>section 7D<\/strong>,\u2014<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">(i) after clause (d), the following clause shall be inserted namely:\u2014<\/p>\n<p style=\"text-align: justify;\">\u201c(da) the Overseas Citizen of India Cardholder has violated any of the provisions of this Act or provisions of any other law for the time being in force as may be specified by the Central Government by notification published in the Official Gazette; or\u201d;<\/p>\n<p style=\"text-align: justify;\">(ii) after clause (f), the following proviso shall be inserted, namely:\u2014<\/p>\n<p style=\"text-align: justify;\">\u201cProvided that no order under this section shall be passed unless the Overseas Citizen of India Cardholder has been given a reasonable opportunity of being heard.\u201d<\/p>\n<ul style=\"text-align: justify;\">\n<li>In the principal Act, in the<strong> Third Schedule<\/strong>, in clause (d), the following proviso shall be inserted, namely:\u2014<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">\u201cProvided that for the persons belonging to minority communities, namely, Hindus, Sikhs, Buddhists, Jains, Parsis and Christians from Afghanistan, Bangladesh and Pakistan, the aggregate period of residence or service of a Government in India as required under this clause shall be read as \u201cnot less than six years\u201d in place of \u201cnot less than eleven years\u201d.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>As per the reports of ANI, the Citizenship Amendment Bill, 2019 has been approved by the Union Cabinet.
