{"id":222693,"date":"2019-11-29T16:30:51","date_gmt":"2019-11-29T11:00:51","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=222693"},"modified":"2019-11-29T16:08:28","modified_gmt":"2019-11-29T10:38:28","slug":"lok-sabha-passes-the-national-capital-territory-of-delhi-recognition-of-property-rights-of-residents-in-unauthorised-colonies-bill-2019","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2019\/11\/29\/lok-sabha-passes-the-national-capital-territory-of-delhi-recognition-of-property-rights-of-residents-in-unauthorised-colonies-bill-2019\/","title":{"rendered":"Lok Sabha passes the National Capital Territory of Delhi (Recognition of Property Rights of Residents in Unauthorised Colonies) Bill, 2019"},"content":{"rendered":"<p style=\"text-align: justify;\">Lok Sabha passed <strong><span style=\"color: #ff0000;\">the National Capital Territory of Delhi (Recognition of Property Rights of Residents in Unauthorised Colonies) Bill, 2019.<\/span><\/strong><\/p>\n<p style=\"text-align: center;\"><span style=\"color: #0000ff;\"><strong>Purpose of the Bill<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">It provides special provisions for the <span style=\"color: #ff0000;\"><strong>National Capital Territory of Delhi for recognising the property rights of resident in unauthorised colonies<\/strong><\/span> by securing the rights of ownership or transfer or mortgage in favour of the residents of such colonies<br \/>\nwho are possessing properties on the basis of Power of Attorney, Agreement to Sale, Will, possession letter or any other documents including documents evidencing payment of consideration and for the matters connected therewith or incidental thereto.<\/p>\n<p style=\"text-align: justify;\"><strong>Few of the important definition laid down under the bill are:<\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li><strong><span style=\"color: #ff0000;\"> &#8220;resident&#8221;<\/span><\/strong> means a person having physical possession of property on the basis of a registered sale deed or latest Power of Attorney, Agreement to Sale, Will, possession letter and other documents including documents evidencing payment of consideration in respect of a property in unauthorised colonies and includes their legal heirs but does not include tenant, licensee or permissive user.<\/li>\n<li><span style=\"color: #ff0000;\"><strong>&#8220;unauthorised colony&#8221;<\/strong> <\/span>means a colony or development comprising of a contiguous area, where no permission has been obtained for approval of layout plan or building plans and has been identified for regularisation of such colony in pursuance to the notification number S.O. 683(E), dated the 24-03-2008 of the Delhi Development Authority, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated the 24-03- 2008.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #008000;\"><span style=\"color: #ff0000;\"><strong>*Please follow the link to read the bill &#8212;<\/strong><\/span> <strong><a href=\"http:\/\/164.100.47.4\/BillsTexts\/LSBillTexts\/PassedLoksabha\/360C_2019_LS_Eng.pdf\">National Capital Territory of Delhi (Recognition of Property Rights of Residents in Unauthorised Colonies) Bill, 2019<\/a>.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">\n","protected":false},"excerpt":{"rendered":"<p>Lok Sabha passed the National Capital Territory of Delhi (Recognition of Property Rights of Residents in Unauthorised Colonies) Bill, 2019.
