No. L-3(2)\/Regln-Gen. (Amdt.)\/2019\/CCI.\u2014<\/strong>In exercise of the powers conferred by Section 64 of the Competition Act, 2002 (12 of 2003), the Competition Commission of India hereby makes the following regulations further to amend the Competition Commission of India (General) Regulations, 2009, namely:\u2014<\/p>\n

1. (1) These regulations may be called the Competition Commission of India (General) Amendment Regulations, 2019<\/strong><\/span>.<\/p>\n

(2) They shall come into force on the date of their publication in the Official Gazette.<\/p>\n

2. In the Competition Commission of India (General) Regulations, 2009,–<\/strong><\/p>\n

(1) in regulation 10, in sub-regulation (2), after clause (d), the following clause shall be inserted, namely :-<\/p>\n

\u201c(da) Details of litigation or dispute pending between the informant and parties before any court, tribunal, statutory authority or arbitrator in respect of the subject matter of information;”;<\/em><\/p>\n

(2) in Regulation 35,-<\/strong><\/p>\n

(a) after sub-regulation (1), the following proviso shall be inserted, namely:-<\/p>\n

\u201cProvided that where it is expedient to disclose the identity of the informant for the purposes of the Act, the Commission shall do so after giving an opportunity to the informant of being heard.”;<\/em><\/p>\n

(b) in sub-regulation (10), after the words \u201cregarding confidential treatment\u201d the following words and figures shall be inserted, namely:-<\/p>\n

\u201cwithin a period not exceeding 30 days from the receipt of the order passed by the Director-General.\u201d;<\/em><\/p>\n

(3) in Regulation 49, for sub-regulation (1), the following sub-regulation shall be substituted, namely:-<\/strong><\/p>\n

\u201c(1) Each information received under clause (a) of sub-section (1) of Section 19 of the Act from any person shall be accompanied by proof of having paid the fee as under,\u2014<\/p>\n

(a) \u00a0rupees 5,000 (five thousand) in case of individual or Hindu Undivided Family (HUF), or<\/em><\/p>\n

(b) \u00a0rupees 10,000 (ten thousand) in case of Non-Government Organisation (NGO), or Consumer Association, or a Co-operative Society, or Trust, or<\/em><\/p>\n

(c) \u00a0rupees 40,000 (forty thousand) in case of firm (including proprietorship, partnership or Limited Liability Partnership) or company (including one person company) having <\/em>a turnover in the preceding year <\/em>upto rupees two <\/em>crore, or<\/em><\/p>\n

(d) \u00a0rupees 1,00,000 (one lac) in case of firm (including proprietorship, partnership or Limited Liability Partnership) or company (including one person company) having <\/em>a turnover in the preceding year exceeding rupees two <\/em>crore and <\/em>upto rupees 50 crore<\/em><\/p>\n

(e) \u00a0rupees 5,00,000 (five lacs) in the cases not covered under clause (a) or (b) or (c) or (d).”<\/em><\/p>\n
