{"id":221627,"date":"2019-10-31T16:30:34","date_gmt":"2019-10-31T11:00:34","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=221627"},"modified":"2019-11-04T14:51:07","modified_gmt":"2019-11-04T09:21:07","slug":"ph-hc-high-court-can-exercise-review-jurisdiction-during-the-pendency-of-slp-and-also-after-its-dismissal-by-a-speaking-or-non-speaking-order","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2019\/10\/31\/ph-hc-high-court-can-exercise-review-jurisdiction-during-the-pendency-of-slp-and-also-after-its-dismissal-by-a-speaking-or-non-speaking-order\/","title":{"rendered":"P&#038;H HC | High Court can exercise review jurisdiction during the pendency of SLP and also after its dismissal (by a speaking or non-speaking order)"},"content":{"rendered":"<p class=\"s3\" style=\"text-align: justify;\"><strong><span class=\"s2\"><span class=\"bumpedFont15\">Punjab and Haryana H<\/span><\/span><span class=\"s2\"><span class=\"bumpedFont15\">igh <\/span><\/span><span class=\"s2\"><span class=\"bumpedFont15\">C<\/span><\/span><span class=\"s2\"><span class=\"bumpedFont15\">ourt<\/span><\/span><span class=\"s2\"><span class=\"bumpedFont15\">: <\/span><\/span><\/strong><span class=\"s4\"><span class=\"bumpedFont15\">A Division Bench of Daya Chaudhary and Sudhir Mittal, JJ.<\/span><\/span> <span class=\"s4\"><span class=\"bumpedFont15\">dismissed<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> the review <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">application filed by a person against the order passed by the State of Punjab<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> regarding the <em>inter se<\/em> merit of sportspersons.<\/span><\/span><\/p>\n<p class=\"s3\" style=\"text-align: justify;\"><span class=\"s4\"><span class=\"bumpedFont15\">An <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">order<\/span><\/span> <span class=\"s4\"><span class=\"bumpedFont15\">was issued <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">by the State of Punjab<\/span><\/span> <span class=\"s4\"><span class=\"bumpedFont15\">giving directions for reservations of sportspersons<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">;<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> a<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">gainst which the petitioner had filed a case stating that w<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">hile deciding the <em>inter se<\/em> merit<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> of the students with the same sports gradation, me<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">rit was<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> being<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> ignored. The Court <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">held that the <em>inter se<\/em> merit of candidates within the same sports gradation has to be determined on the basis of merit.<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> However<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> t<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">he State of Punjab sought Special Leave <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">to Appeal.<\/span><\/span> <span class=\"s4\"><span class=\"bumpedFont15\">In the SLP, it was <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">d<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">irected by the Supreme Court that counseling would take place<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> as per the order passed by the High Court.<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> Meanwhile, a<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> revised merit list was uploaded in which the merit posit<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">ions of candidates were lowered<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">. <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Thus, the instant <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">review application <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">was filed.<\/span><\/span><\/p>\n<p class=\"s3\" style=\"text-align: justify;\"><span class=\"s4\"><span class=\"bumpedFont15\">In reply to the review application, the <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">State of Punjab <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">submitted<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> that the <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">merit list was governed by Clause 6 of the Sports Gradation P<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">olicy dated 10-12-1997.<\/span><\/span><\/p>\n<p class=\"s3\" style=\"text-align: justify;\"><span class=\"s4\"><span class=\"bumpedFont15\">B.S.Patwalia<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> learned counsel for the non-applicant petitioner<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> argued that the review application <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">was<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> not maintainable as <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">a <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">petition<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> see<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">king Special Leave to Appeal was<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> pending before the Supreme Court.<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> Whereas\u00a0<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Gurminder Singh, learned senior counsel for the review applicants<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> stated that<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> the pendency of SLP<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> d<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">id<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> not bar this court from exercising its review jurisdic<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">tion because the subject matter<\/span><\/span> <span class=\"s4\"><span class=\"bumpedFont15\">in both the matters was<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> different.<\/span><\/span><\/p>\n<p class=\"s3\" style=\"text-align: justify;\"><span class=\"s4\"><span class=\"bumpedFont15\">The Court held that the pendency of such<\/span><\/span> <span class=\"s4\"><span class=\"bumpedFont15\">SLP<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> does not <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">attract\u00a0<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">the doctrine of merger.<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> Even if, the SLP is dismissed by passing a speaking order, the doctrine of merger is not attracted. <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">It relied on<\/span><\/span> <span class=\"s4\"><span class=\"bumpedFont15\">the judgment in <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">K<em>hoday Distilleries Ltd<\/em><\/span><\/span><em><span class=\"s5\"><span class=\"bumpedFont15\">. v. Sri Mahadeshwara Sahakara<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\"> Sakkare Karkhane Ltd.<\/span><\/span><\/em><span class=\"s4\"><span class=\"bumpedFont15\">, <a href=\"http:\/\/scconline.com\/\/DocumentLink\/90mxG1mN\">(2019) 4 SCC 376<\/a><\/span><\/span>\u00a0<span class=\"s4\"><span class=\"bumpedFont15\">to hold that <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">a High Court can exercise review jurisdict<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">ion during the pendency of an SLP<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">. <\/span><\/span><\/p>\n<p class=\"s3\" style=\"text-align: justify;\"><span class=\"s4\"><span class=\"bumpedFont15\">However, <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">it was opined that <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">the counseling order passed by the Supreme Court <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">could not <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">be ignored<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">. <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Relying on<\/span><\/span> <em><span class=\"s5\"><span class=\"bumpedFont15\">Abbai Maligai<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\"> Partnership F<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">irm v. K. Santhakumaran<\/span><\/span><\/em><span class=\"s4\"><span class=\"bumpedFont15\">, <a href=\"http:\/\/scconline.com\/\/DocumentLink\/58LcV8kb\">(1998) 7 SCC 386<\/a><\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">, the <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">C<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">ourt <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">refrained from passing<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> any order contrary to the d<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">irections of the Supreme Court and directed <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">the applicants to seek clarification from the Supreme Court. <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">[Rimnaaz v. State of Punjab,\u00a0 <a href=\"http:\/\/scconline.com\/\/DocumentLink\/vd00XaNe\"><b>2019 SCC OnLine P&amp;H 1704<\/b><\/a><\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">, <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">decided on 06-09-2019<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">]<\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Punjab and Haryana High Court: A Division Bench of Daya Chaudhary and Sudhir Mittal, JJ. dismissed the
