Patna High Court: <\/span><\/span><\/strong>Chakradhari Sharan Singh<\/span><\/span>,<\/span><\/span> J. dismissed the application <\/span><\/span>challenging the guidelines on determining merit <\/span><\/span>on the basis of work experience.<\/span><\/span><\/p>\n

A petition was filed challenging the <\/span><\/span>engagement of <\/span><\/span>an <\/span><\/span>Accountant on<\/span><\/span> contractual basis under Sub-Mission on Agricultural Extension<\/span><\/span> (ATMA Yojana) at the District\/Block level under the guidelines<\/span><\/span> issued by the Director Bihar Agricultural Management and<\/span><\/span> Extensi<\/span><\/span>on Training Institute (BAMETI).<\/span><\/span> Clause 11 of the guidelines dealt with determination of merit points for the post of accountant, on the basis of percentage of marks secured by candidates in different examinations (Matriculation and intermediate). Sub Clause<\/span><\/span> \u201c<\/span><\/span>kha<\/span><\/span>\u201d (Hindi Alphabet)<\/span><\/span> of Clause 11 of the <\/span><\/span>guidelines <\/span><\/span>stipulated<\/span><\/span> giving weightage <\/span><\/span>to those <\/span><\/span>candidates<\/span><\/span> who had<\/span><\/span> work experience of more than the minimum work-experience prescribed under the guidelines.<\/span><\/span><\/p>\n

The Court noted that <\/span><\/span>for considering \u2018work experience\u2019 as minimum eligibility<\/span><\/span> condition, the experience of having worked in a \u2018private organization\u2019,<\/span><\/span> as an Accountant, had\u00a0<\/span><\/span>been made admissible. <\/span><\/span>Hence <\/span><\/span>a<\/span><\/span>ny<\/span><\/span> person who possessed experience<\/span><\/span>\u00a0of having worked for three years<\/span><\/span> under the State Government of Bihar or the Government of India or any Semi-Government Organizations\/<\/span><\/span>Autonomous Organizations<\/span><\/span> under the Central Government or the State Governme<\/span><\/span>nt or any <\/span><\/span>reputed Private Organizations<\/span><\/span> dealing with agriculture, wa<\/span><\/span>s<\/span><\/span> eligible to be considered.\u00a0<\/span><\/span>However, Sub Clause \u201ckha\u201d<\/span><\/span> of Clause 11 of the guidelines did<\/span><\/span>\u00a0not include <\/span><\/span>experience gained by a person<\/span><\/span>\u00a0having worked<\/span><\/span>\u00a0in a private organization.<\/span><\/span><\/p>\n

The only grievance<\/span><\/span> of <\/span><\/span>the petitioner <\/span><\/span>was <\/span><\/span>that<\/span><\/span> weightage should be given to him for his work experience in a<\/span><\/span> private organization. The petitioner <\/span><\/span>has thus <\/span><\/span>challenged\u00a0<\/span><\/span>the letter whereby it was notified<\/span><\/span> that weightage against<\/span><\/span> work experience shall be given, only if such experience has been gained<\/span><\/span>\u00a0while working in <\/span><\/span>the categories mentioned above.<\/span><\/span><\/p>\n

The counsel on behalf of the petitioner <\/span><\/span>relied <\/span><\/span>on Clause 2 of the guidelines and <\/span><\/span>argued that work experience<\/span><\/span> in a private organizatio<\/span><\/span>n dealing with the agriculture wa<\/span><\/span>s a valid and<\/span><\/span> recognized qualification and in that background, subsequent<\/span><\/span> guidelines dated 22.07.2019 denying work experience<\/span><\/span>\u00a0under a private organization for the purpose of grant of<\/span><\/span> weightage, wa<\/span><\/span>s arbitrary and illegal. <\/span><\/span><\/p>\n

The <\/span><\/span>C<\/span><\/span>ourt held that i<\/span><\/span>t <\/span><\/span>wa<\/span><\/span>s evincible<\/span><\/span> on a perusal<\/span><\/span> of <\/span><\/span>Clause 2.1 of the guidelines <\/span><\/span>that<\/span><\/span> three years\u2019 work experience in Government\/Semi-Government\/Autonomous Organizations under the State<\/span><\/span> Government and<\/span><\/span> even in Private Organizations wa<\/span><\/span>s a valid minimum<\/span><\/span> eligibility qualification for being considered for selection and<\/span><\/span> appoi<\/span><\/span>ntment as an Accountant. There wa<\/span><\/span>s<\/span><\/span> a<\/span><\/span> clear distinction between<\/span><\/span> Clause 2 and Clause 11 of the guidelines <\/span><\/span>which could be easily noticed since<\/span><\/span> Clause 11<\/span><\/span> did<\/span><\/span> not prescribe giving<\/span><\/span> weightage to candidates who have acquired work experience in a private organization.<\/span><\/span>[<\/span><\/span>Rajeev Ranjan<\/span><\/span> v.
