{"id":220655,"date":"2019-10-10T12:00:24","date_gmt":"2019-10-10T06:30:24","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=220655"},"modified":"2019-11-29T12:32:31","modified_gmt":"2019-11-29T07:02:31","slug":"cic-enforcement-directorate-exempted-under-s-24-of-rti-act-from-disclosing-information-regarding-panama-paper-leak-case","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2019\/10\/10\/cic-enforcement-directorate-exempted-under-s-24-of-rti-act-from-disclosing-information-regarding-panama-paper-leak-case\/","title":{"rendered":"CIC | Enforcement Directorate exempted under S. 24 of RTI Act from disclosing information regarding &#8220;Panama Paper Leak Case&#8221;"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Central Information Commission (CIC): <\/strong>Bimal Jhulka, Information Commissioner, disposed of an appeal with respect to the information being sought from Directorate of Enforcement in the very famous <strong>Panama Paper Leak Case.<\/strong><\/p>\n<p style=\"text-align: justify;\">The facts of the present case are that, the appellant had filed an RTI application seeking information regarding the details of people who were involved in the Panama Papers; action was taken with respect to that and the details of officers responsible for the delay in Panama Papers Leak case investigation. In respect to the stated, CPIO had informed that their Organization was exempted under Section 24 read with Second Schedule of RTI Act, 2005.<\/p>\n<p style=\"text-align: justify;\">Appellant on being dissatisfied with the above response of the CPIO approached the FAA, though FAA upheld the CPIO\u2019s response.<\/p>\n<p style=\"text-align: justify;\">Appellant reiterated the RTI Application\u2019s content that he had filed earlier and added that the information sought by him was not provided to him whereas it was a serious matter pertaining to corruption at higher levels.<\/p>\n<p style=\"text-align: justify;\">Respondent is represented by Vipin, APIO and Rajesh Ridla, Assistant Legal Advisor, \u00a0also reiterated its response that their organization was exempted under Section 24 read with Second Schedule of RTI Act, 2005 and also the matter was sub-judice due to which no further details could be disclosed at this stage.<\/p>\n<p style=\"text-align: justify;\">Commission on noting the above-stated position referred to the definition of <strong>\u201cInformation\u201d <\/strong>under Section 2(f) of RTI Act, 2005, which is as follows:<\/p>\n<p style=\"text-align: justify;\"><em>\u201cinformation\u201d means any material in any form, including records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, report, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force.<\/em><\/p>\n<p style=\"text-align: justify;\">Along with the above-stated definition of \u201cinformation\u201d, Commission also mention the relevant extract of Section 2 (j) of the Act, for reference, which read as follows:<\/p>\n<p style=\"text-align: justify;\"><em>\u201c(j) right to information\u201d means the right to information accessible under this Act which <\/em><em>is held by or under the control of any public authority and includes &#8230;&#8230;..\u201d<\/em><\/p>\n<p style=\"text-align: justify;\">Further, the reference was made to the Supreme Court case, <em>CBSE v. Aditya Bandopadhyay, <\/em><a href=\"http:\/\/scconline.com\/DocumentLink\/9n8fTiqt\">(2011) 8 SCC 497<\/a>. Following the mentioned case, another reference was made to the decision of Supreme Court in <em>Khanapuram Gandaiah v. Administrative Officer, <\/em><a href=\"http:\/\/scconline.com\/DocumentLink\/54MbGWA2\">(2010) 2 SCC 1<\/a>, wherein it was held that,<\/p>\n<p style=\"text-align: justify;\"><em>Under Section 6 of the RTI Act, an applicant is entitled to get only such information that can be accessed by the \u201cpublic authority\u201d under any other law for the time being in force. The answers sought by the petitioner in the application could not have been with the public authority nor could he have had access to this information and Respondent No. 4 was not obliged to give any reasons as to why he had taken such a decision in the matter which was before him.\u201d<\/em><\/p>\n<p style=\"text-align: justify;\">Commission observed that the ED was included in the list of organization exempted from the purview of the RTI Act, 2005 as per Section 24 read with Second Schedule of the RTI Act, 2005.<\/p>\n<p style=\"text-align: justify;\">In regard to the information being sought in the present case, another reference was made to the decision in <em>CPIO, Directorate of Enforcement v. Bimal Kumar Bhattacharya<\/em>, WP (C) No. 345 of 2018, wherein it was held that,<\/p>\n<p style=\"text-align: justify;\"><em>\u201c6. Plainly, the impugned order cannot be sustained as it is contrary to the expressed language of Section 24(1) of the Act. Section 24(1) of the Act expressly excludes intelligence and security organizations specified in the Second Schedule of the Act from the purview of the Act. Admittedly, the Directorate of Enforcement is included in the Second Schedule to the Act and, thus, cannot be called upon to disclose information under the provisions of the Act. The only exception carved out from the exclusionary clause of Section 24(1) of the Act relates to information pertaining to allegations of corruption and human rights violation. Undisputedly, the information sought for by the petitioner cannot be categorized as such information.<\/em><\/p>\n<p style=\"text-align: justify;\">Thus, in view of the facts and circumstances of the case along with the reference to the decision of the Superior Courts, Commission held that <strong>no further intervention of the Commission is required in the matter in light of protection being granted to the respondent public authority under Section 24 of the RTI Act, 2005.<\/strong> [Durga Prasad Choudhary v. CPIO, Directorate of Enforcement, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/4HlVq8T1\"><b>2019 SCC OnLine CIC 1231<\/b> <\/a>, decided on 04-10-2019]<\/p>\n<hr \/>\n<p><span style=\"color: #ff0000;\"><strong>For Reference:<\/strong><\/span><\/p>\n<p><span style=\"color: #008000;\"><strong><a style=\"color: #008000;\" href=\"http:\/\/scconline.com\/DocumentLink\/HWO3Ya36\">Section 24 of
