Jadhav, J. remanded back a matter of <strong>\u201cRashtriya Mul Niwasi Bahujan Karamchari Sangh\u201d <\/strong>to the Industrial Court for a fresh hearing.<\/p>\n<p style=\"text-align: justify;\">In the present matter, the petitioner challenged the impugned award passed by the Industrial Court. The said award held that the petitioner-Union failed to prove that workers mentioned in the settlement of claim have been illegally terminated and therefore, are not entitled to relief and reinstatement.<\/p>\n<p style=\"text-align: justify;\">The facts pertinent to the present matter are, the respondent is a private hotel which employs workmen\/employees. Petitioner is a labour union of workmen working in the respondent\u2019s hotel. Services of all these 28 members came to be orally terminated by the respondent\u2019s management as they chose to join the petitioner-Union as its members.<\/p>\n<p style=\"text-align: justify;\">Further adding to the above-stated facts, Regional President of the petitioner\u2013Union addressed a communication to the respondent\u2019s management to reinstate the terminated employees. Since no action was taken, petitioner-Union filed the dispute before the Assistant Labour Commissioner.<\/p>\n<p style=\"text-align: justify;\">In the meanwhile, the respondent\u2019s management succeeded in getting back 12 employees out of the aforesaid 27 employees back on work and re-employed them by making them sign a backdated apology letter to the management.<\/p>\n<p style=\"text-align: justify;\">Industrial Court, while adjudicating the aforesaid issue, <em>inter alia, <\/em>answered the Reference in negative and held that the petitioner-Union failed to prove that the workers mentioned in the statement of claim were illegally terminated and therefore, they were not entitled to reinstatement and against this order, parties reached the High Court.<\/p>\n<p style=\"text-align: justify;\"><strong>Contentions<\/strong><\/p>\n<p style=\"text-align: justify;\">Counsel for the petitioner-Union, Vinay Dahat, submitted that the order passed by the Industrial Court was patently illegal, perverse and against settled principles of law.<\/p>\n<p style=\"text-align: justify;\">He submitted that it was never denied by the respondent\u2019s management at any point of time that the affected workers were employees of the respondent\u2019s management. Affected workers along with several workers who have been reinstated were admittedly part of respondent\u2019s management.<\/p>\n<p style=\"text-align: justify;\">It was added to the above contentions that it was a basic fundamental right of the employees working in the respondent\u2019s management to form a union and the <strong>respondent\u2019s management was uncomfortable with it and victimized the workman who became members of the petitioner-union and it was this victimization which was spelt out in the oral termination of employees.<\/strong><\/p>\n<p style=\"text-align: justify;\">Petitioner-Union had filed its evidence but the said evidence was not controverted and no cross-examination could take place because the respondent\u2019s management absented itself from the said proceedings.<\/p>\n<p style=\"text-align: justify;\"><strong>Conclusion &amp; Observations<\/strong><\/p>\n<p style=\"text-align: justify;\">High Court on perusal of the facts, submissions and circumstances of the case held that,<\/p>\n<p style=\"text-align: justify;\">Industrial Court did not take into account that despite evidence been led by the petitioner-Union and the said evidence not being controverted, there was no reason for not accepting the evidence and to consider answering the Reference otherwise, especially in view of the facts that the Respondent\u2019s management had chosen to remain away from the proceedings before the Assistant Labour Commissioner, as well as before the Industrial Court in the Reference Proceedings.<\/p>\n<p style=\"text-align: justify;\"><strong>Important points of observation:<\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li>Oral termination clearly appeared to be victimization of employees by the respondent\u2019s management.<\/li>\n<li>The impugned award has determined points for consideration and the principal point is that whether the petitioner-union proved that the respondent\u2019s management has illegally terminated the 17 workers and the said pint was answered in negative.<\/li>\n<li>No finding to the effect that termination of these 27 workers was oral and in what circumstances the termination was made.<\/li>\n<li>An Annexure stating the details of employment of all the workers was provided, therefore it is highly unlikely for Industrial Court to come to the conclusion that there is no document on record to show the number of days workers worked for the respondent\u2019s management.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Thus, in view of the above reasons, the impugned award is set aside and quashed by remanding back to the Industrial Court for fresh consideration.
