SEBI\/LAD-NRO\/GN\/2019\/21.\u2014<\/strong>In exercise of the powers conferred by Sections 4, 8A and 31 of the Securities Contracts (Regulation) Act, 1956, read with Sections 11 and 30 of the Securities and Exchange Board of India Act, 1992, the Securities and Exchange Board of India hereby makes the following regulations to further amend the Securities Contracts (Regulation) (Stock Exchanges and Clearing Corporations) Regulations, 2018, namely:\u2014<\/p>\n<p style=\"text-align: justify;\"><strong>1.<\/strong> These regulations may be called the <strong><span style=\"color: #800080;\">Securities Contracts (Regulation) (Stock Exchanges and<\/span> <span style=\"color: #800080;\">Clearing Corporations) (Amendment) Regulations, 2019<\/span><\/strong><span style=\"color: #800080;\">.<\/span><\/p>\n<p style=\"text-align: justify;\"><strong>2.<\/strong> Save as otherwise specifically provided for in these regulations, they shall come into force on the date of their publication in the Official Gazette.<\/p>\n<p style=\"text-align: justify;\"><strong>3.<\/strong> In the Securities Contracts (Regulation) (Stock Exchanges and Clearing Corporations) Regulations, 2018,\u2014<\/p>\n<p style=\"text-align: justify;\">(i) in regulation 2, in sub-regulation (1), clause (g) shall be omitted.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 The aforesaid amendment shall deemed to have come into force with effect from October 3, 2018.<\/p>\n<p style=\"text-align: justify;\">(ii) in Regulation 29, in sub-regulation (2),<\/p>\n<p style=\"text-align: justify;\">a) clause (a) shall be substituted with the following words:<\/p>\n<p style=\"text-align: justify;\">\u201cMember and Core Settlement Guarantee Fund committee;\u201d<\/p>\n<p style=\"text-align: justify;\">b) in clause (b), the word \u201cinvestor\u201d shall be omitted.<\/p>\n<p style=\"text-align: justify;\">(iii) in Regulation 35, after sub-regulation (1) and prior to sub-regulation (2), the following proviso shall be inserted, namely,-<\/p>\n<p style=\"text-align: justify;\">\u201cProvided that in case a recognised stock exchange enters into an arrangement with more than one recognised clearing corporation, it shall enter into a multipartite agreement in writing with such recognised clearing corporations to ensure interoperability among the clearing corporations.\u201d<\/p>\n<p style=\"text-align: justify;\">(iv) in Regulation 37, in sub-regulation (1), the proviso shall be omitted.<\/p>\n<p>(v) in Regulation 38, in sub-regulation (2), in the second proviso, the word &#8220;except\u201d shall be omitted.<\/p>\n<p style=\"text-align: justify;\">(vi) in Regulation 42, in sub-regulation (3), after the words and symbols<br \/>\n\u201cArticles\/Rules\/Bye-laws\u201d the word and symbol \u201c\/Regulations\u201d shall be omitted.<\/p>\n<p style=\"text-align: justify;\">(vii) after Regulation 43 and prior to Regulation 44, the following regulation shall be inserted, namely;-<\/p>\n<p style=\"text-align: justify;\"><strong>\u201cObligation of Clearing Corporation in Commodity Derivatives<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>43A.<\/strong> Every recognized Clearing Corporation providing clearing and settlement services for commodity derivatives shall ensure guarantee for settlement of trades including good delivery.<\/p>\n<p style=\"text-align: justify;\">Explanation: For the purpose of this regulation, \u201cgood delivery\u201d shall mean the delivery of goods that is in proper form to transfer title and is of the quality and quantity as per contract specifications of the concerned exchange.\u201d<br \/>\nThe aforesaid amendment shall deemed to have come into force with effect from October 3, 2018.<\/p>\n<p style=\"text-align: justify;\">(viii) in SCHEDULE &#8211; II, in PART &#8211; E,<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0a) in the heading, the symbol and word \u201c\/Regulations\u201d shall be omitted.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0b) in clause (2),<\/p>\n<p style=\"text-align: justify;\">a. in the heading, after the words and symbols \u201cArticles\/Rules\/Bye-laws\u201d the symbol and word \u201c\/Regulations\u201d shall be omitted.<br \/>\nb. after the word \u201cbye-laws\u201d the symbol and word \u201c, Regulations\u201d shall be omitted.<\/p>\n<p style=\"text-align: justify;\">(ix) in SCHEDULE &#8211; II, in PART &#8211; H, under the sub-heading \u201cManaging Director \/ Executive Director:\u2014\u201d, in clause (1), the following words and symbols \u201cIn case of reappointment, or extension of appointment, the stock exchange\/clearing corporation shall apply to the Board two months before the last working day of such Managing Director.\u201d shall be substituted by the following, namely,\u2014<\/p>\n<p style=\"text-align: justify;\">\u201cThe stock exchange\/ clearing corporation shall forward the new names to the Board before two months from the last working day of the existing Managing Director.\u201d<\/p>\n<p style=\"text-align: justify;\">(x) in SCHEDULE &#8211; II, in PART &#8211; H, under the heading \u201cAppointment of Directors\u201d,\u2014<\/p>\n<p style=\"text-align: justify;\">a) the symbols \u201c(I)\u201d shall be inserted before the sub-heading \u201cProcedure for appointment:\u2014\u201d;<\/p>\n<p style=\"text-align: justify;\">b) the symbols \u201c(II)\u201d shall be inserted before the sub-heading \u201cManaging Director\/ Executive Director:\u2014\u201d;<\/p>\n<p>c) the symbols \u201c(III)\u201d shall be inserted before the sub-heading \u201cPublic Interest Directors:\u2014\u201d;<\/p>\n<p style=\"text-align: justify;\">d) the symbols \u201c(IV)\u201d shall be inserted before the sub-heading \u201cShare Holder Directors\u201d;<\/p>\n<p style=\"text-align: justify;\">e) the symbols \u201c(V)\u201d shall be inserted before the sub-heading \u201cSelection of trading members\/clearing members on the Advisory Committee to the governing board:\u2014\u201d;<\/p>\n<p style=\"text-align: justify;\">f) the symbols \u201c(VI)\u201d shall be inserted before the sub-heading \u201cGeneral conditions on appointment of directors:\u2014\u201d<\/p>\n<hr \/>\n<p style=\"text-align: justify;\">[<span
