Short title and commencement\u2014<\/strong> (1) These rules may be called the <span style=\"color: #800000;\"><strong>Prohibition of Benami Property Transactions (Conditions of services of Members of Adjudicating Authority) Rules, 2019<\/strong><\/span>.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 (2) They shall come into force on the date of their publication in the Official Gazette.<\/p>\n<p style=\"text-align: justify;\"><strong>2. Definition?<\/strong> (1) In these rules, unless the context otherwise requires,?<\/p>\n<p style=\"text-align: justify;\">(a) \u201cAct\u201d means the Prohibition of Benami Property Transactions Act, 1988 (45 of 1988);<\/p>\n<p style=\"text-align: justify;\">(b) \u201cSearch\u2013cum\u2013Selection Committee\u201d means the Search\u2013cum\u2013Selection Committee as referred to in Rule 3;<\/p>\n<p style=\"text-align: justify;\">(c) \u201csection\u201d means a section of the Act.<\/p>\n<p style=\"text-align: justify;\">(2) Words and expression used and not defined in these rules but defined in the Act shall have the same meanings respectively assigned to them in the Act.<\/p>\n<p style=\"text-align: justify;\">3. <strong>Method of recruitment?<\/strong> (1) The Member of the Adjudicating Authority shall be appointed by the Central Government, on the recommendation of the Search\u2013cum\u2013Selection Committee specified in sub-rule (4) in respect of the said members.<\/p>\n<p style=\"text-align: justify;\">(2) The Search\u2013cum\u2013Selection Committee shall determine its procedure for making its recommendation.<\/p>\n<p style=\"text-align: justify;\">(3) No appointment of Member of the Adjudicating Authority shall be invalid merely by reason of any vacancy or absence in the Search\u2013cum\u2013Selection Committee.<\/p>\n<p style=\"text-align: justify;\">(4) The Search\u2013cum\u2013Selection Committee for the post of the Member of the Adjudicating Authority shall consist of,\u2014<\/p>\n<p style=\"text-align: justify;\">(i) Secretary to the Government of India, Ministry of Finance, Department of Revenue \u2014 Chairperson;<\/p>\n<p style=\"text-align: justify;\">(ii) Secretary to the Government of India, Ministry of Law and Justice, Department of Legal Affairs \u2014 Member;<\/p>\n<p style=\"text-align: justify;\">(iii) Chairperson, Central Board of Direct Taxes \u2014 Member.<\/p>\n<p><strong><span
