{"id":212607,"date":"2019-03-29T08:00:46","date_gmt":"2019-03-29T02:30:46","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=212607"},"modified":"2019-03-29T10:19:28","modified_gmt":"2019-03-29T04:49:28","slug":"cout-cant-interfere-with-certification-of-finance-bill-of-2017-as-money-bill-centre-to-sc","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2019\/03\/29\/cout-cant-interfere-with-certification-of-finance-bill-of-2017-as-money-bill-centre-to-sc\/","title":{"rendered":"Court can&#8217;t interfere with certification of Finance Bill of 2017 as Money Bill: Centre to SC"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Supreme Court<\/strong>: The Centre told the 5-judge bench of Ranjan Gogoi, CJ and N V Ramana, D Y Chandrachud, Deepak Gupta and Sanjiv Khanna, JJ that Finance Bill of 2017 was certified as a Money Bill by the Speaker\u00a0of the\u00a0Lok Sabha\u00a0and judicial review of that decision cannot be done.<\/p>\n<p style=\"text-align: justify;\">Attorney General\u00a0K K Venugopal told the Court that petitioners&#8217; contention that certification of Finance\u00a0Bill of 2017 as\u00a0Money Bill\u00a0was not right cannot be a ground for a challenge to the Bill. He said:<\/p>\n<blockquote><p>&#8220;The Act of 2017 deals with various aspects of\u00a0finance. Speaker\u00a0of the House gave the certification that Finance Act was a Money Bill. Finance Act of 2017 was passed by the Parliament as a Money Bill irrespective of the objections in Rajya Sabha.&#8221;<\/p><\/blockquote>\n<p style=\"text-align: justify;\">He added that <em>&#8220;Certification of a particular Act as a Money Bill is an internal functions of the Parliament. If there is any dispute, the\u00a0Speaker\u00a0can applies his mind and takes a decision. No one can questions the bonafide of the Speaker and all members abide by the decision.&#8221;<\/em><\/p>\n<p style=\"text-align: justify;\">Submitting that Supreme Court has repeatedly held in its verdicts that certification cannot be questioned and courts cannot inquire into the decision taken by Parliament, the AG said:<\/p>\n<blockquote><p>&#8220;This aspect is consistent with the broad parameters of separation of powers given in the\u00a0Constitution. Similarly, Parliament cannot interfere with the affairs of judiciary.&#8221;<\/p><\/blockquote>\n<p style=\"text-align: justify;\">He also submitted that the Finance Bill comprises of amendments to several Acts\u00a0and statutes and the petitioners have challenged only one particular aspect saying it cannot be termed as Money Bill.<\/p>\n<blockquote><p>&#8220;The certification of Money Bill is for the whole Finance Bill and saying that a part of the Bill does not qualify for the Money Bill cannot be held to be correct.&#8221;<\/p><\/blockquote>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/blog.scconline.com\/post\/2019\/03\/28\/central-umbrella-body-for-all-tribunals-5-judge-sc-bench-seeks-centres-view\/\">On March 27<\/a>, the Court had said:<\/p>\n<blockquote><p>\u201cIf we hold that it was not a money bill, then the matter rests there but if it is being held by the court that it was a money bill then subsequent issues which pertains to affairs of tribunal will be dealt,\u201d<\/p><\/blockquote>\n<p style=\"text-align: justify;\">The Court clarified that it is not going to hear 20 lawyers on the same point repeatedly saying,<\/p>\n<blockquote><p>\u201cthis anarchy has to stop in the Supreme Court.\u00a0Lawyers are arguing and arguing for 20 days on the same point\u201d.<\/p><\/blockquote>\n<p style=\"text-align: justify;\">It asked the petitioners to discuss among themselves and sort it out as who will advance the arguments and if needed someone else can supplement on a particular point.<\/p>\n<p
