{"id":210902,"date":"2019-02-25T16:30:13","date_gmt":"2019-02-25T11:00:13","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=210902"},"modified":"2019-02-25T15:24:16","modified_gmt":"2019-02-25T09:54:16","slug":"personal-laws-amendment-act-2019-notified","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2019\/02\/25\/personal-laws-amendment-act-2019-notified\/","title":{"rendered":"Personal Laws (Amendment) Act, 2019&#8211;Notified | &#8220;Leprosy&#8221; no more a ground for &#8220;Divorce&#8221;"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>An Act further to amend the Divorce Act, 1869, the Dissolution of Muslim Marriages Act, 1939, the Special Marriage Act, 1954, the Hindu Marriage Act, 1955 and the Hindu Adoptions and Maintenance Act, 1956.<\/strong><\/p>\n<p style=\"text-align: justify;\">BE it enacted by Parliament in the Seventieth Year of the Republic of India as follows:\u2014<\/p>\n<p style=\"text-align: center;\"><strong>CHAPTER I<\/strong><br \/>\n<strong>PRELIMINARY<\/strong><\/p>\n<p style=\"text-align: justify;\">1. (1) This Act may be called the Personal Laws (Amendment) Act, 2019.<br \/>\n(2) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint.<\/p>\n<p style=\"text-align: center;\"><strong>CHAPTER II<\/strong><br \/>\n<strong>AMENDMENT TO THE DIVORCE ACT, 1869<\/strong><\/p>\n<p style=\"text-align: justify;\">2. In the Divorce Act, 1869, in Section 10, in sub-section (1), clause (iv) shall be omitted.<\/p>\n<p style=\"text-align: center;\"><strong>CHAPTER III<\/strong><br \/>\n<strong>AMENDMENT TO THE DISSOLUTION OF MUSLIM MARRIAGES ACT, 1939<\/strong><\/p>\n<p style=\"text-align: justify;\">3. In the Dissolution of Muslim Marriages Act, 1939, in Section 2, in ground (vi), the words &#8220;leprosy or&#8221; shall be omitted.<\/p>\n<p style=\"text-align: center;\"><strong>CHAPTER IV<\/strong><br \/>\n<strong>AMENDMENT TO THE SPECIAL MARRIAGE ACT, 1954<\/strong><\/p>\n<p style=\"text-align: justify;\">4. In the Special Marriage Act, 1954, in Section 27, in sub-section (1), clause (g) shall be omitted.<\/p>\n<p style=\"text-align: center;\"><strong>CHAPTER V<\/strong><br \/>\n<strong>AMENDMENT TO THE HINDU MARRIAGE ACT, 1955<\/strong><\/p>\n<p style=\"text-align: justify;\">5. In the Hindu Marriage Act, 1955, in Section 13, in sub-section (1), clause (iv) shall be omitted.<\/p>\n<p style=\"text-align: center;\"><strong>CHAPTER VI<\/strong><br \/>\n<strong>AMENDMENT TO THE HINDU ADOPTIONS AND MAINTENANCE ACT, 1956<\/strong><\/p>\n<p>6.
