{"id":209657,"date":"2019-02-07T17:30:21","date_gmt":"2019-02-07T12:00:21","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=209657"},"modified":"2019-02-07T14:35:08","modified_gmt":"2019-02-07T09:05:08","slug":"cbic-makes-regulations-to-amend-customs-brokers-licensing-regulations-2018","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2019\/02\/07\/cbic-makes-regulations-to-amend-customs-brokers-licensing-regulations-2018\/","title":{"rendered":"MoF | CBIC makes regulations to amend Customs Brokers Licensing Regulations, 2018"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>G.S.R. 96(E)\u2014<\/strong>In exercise of the powers conferred by sub-section (2) of Section 146 of the Customs Act, 1962 (52 of 1962), the <strong>Central Board of Indirect Taxes and Customs hereby makes the following regulations to amend the Customs Brokers Licensing Regulations, 2018<\/strong>, namely:\u2014<\/p>\n<p style=\"text-align: justify;\">1. (1) These regulations may be called the <strong>Customs Brokers Licensing (Amendment) Regulations, 2019<\/strong>.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 (2) They shall come into force on the date of their publication in the Official Gazette.<\/p>\n<p style=\"text-align: justify;\">2. In the Customs Brokers Licensing Regulations, 2018 (hereinafter referred to as the said regulations), for the words and brackets \u201cDirectorate General of Performance Management (DGPM)\u201d and \u201cDirectorate General of Performance Management\u201d, wherever they occur, the words and brackets, \u201cNational Academy of Customs, Indirect Taxes and Narcotics (NACIN)\u201d shall respectively be substituted.<\/p>\n<p style=\"text-align: justify;\">3. In the said regulations, in <strong>regulation 4<\/strong>, \u2014<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0 (a) in sub-regulation (1), for the word, \u201cApril\u201d, the word, \u201cAugust\u201d shall be substituted;<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0 (b) after sub-regulation (1), the following proviso shall be inserted, namely:\u2014<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u201cProvided that in respect of the applications invited by the Directorate General of Performance Management (DGPM) in April, 2018, the online written examination shall be conducted by the National Academy of Customs, Indirect Taxes and Narcotics (NACIN) in the first quarter of the calendar year 2019.\u201d.<\/p>\n<p style=\"text-align: justify;\">4. In the said regulations, in <strong>regulation 6<\/strong>, \u2014<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0 \u00a0(a) in sub-regulation (1), the words and brackets \u201c(preferably online)\u201d shall be omitted;<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0 \u00a0(b) for sub-regulations (2) and (3), the following sub-regulations shall be substituted, namely:\u2014<\/p>\n<p style=\"text-align: justify;\">\u201c(2) The online written examination shall be conducted by the National Academy of Customs, Indirect Taxes and Narcotics (NACIN) in the first quarter of each calendar year for which intimation shall be sent individually to applicants in advance before the date of examination and the result of the said examination shall be declared preferably within one month of the date of examination.<\/p>\n<p style=\"text-align: justify;\">(3) The applicant who is declared successful in the written examination shall be called for an oral examination on specified dates in the second quarter of the same calendar year, the result of which shall be declared in the month of July of the same calendar year.\u201d<\/p>\n<p style=\"text-align: right;\">Ministry of Finance<\/p>\n<p style=\"text-align: right;\">[F.
