Supreme Court<\/strong>: The bench of NV Ramana and MM Shantanagoudar, JJ, on the issue relating to legality of the marriage of a Muslim man with an idolater or fireworshipper, said that such marriage \u201cis\u00a0neither\u00a0a\u00a0valid\u00a0(sahih)\u00a0nor\u00a0a\u00a0void\u00a0(batil)\u00a0marriage,\u00a0but\u00a0is\u00a0merely an\u00a0irregular\u00a0(fasid)\u00a0marriage.\u201d<\/em><\/p>\n

In the present case, the plaintiff had claimed his share in property of his Muslim father, who had married his Hindu mother. However, the defendants argued that the plaintiff\u2019s mother was not the legally wedded wife of Mohammed Ilias and that she was a Hindu by religion at the time of marriage. She had not converted to Islam at the time of her marriage, and thus the plaintiff was not entitled to any share in the property in question.<\/p>\n

The Court, however, after considering that the marriage in question was an irregular marriage, noticed:<\/p>\n

\u201ct<\/em>he legal effect of a\u00a0 fasid marriage is that in case of consummation, though the wife is entitled to get dower, she is not entitled to inherit the properties of the husband.\u00a0 But the child born in that marriage is legitimate just like in the case of a valid marriage, and is entitled to inherit the property of the father.\u201d<\/em><\/p>\n

Based on the finding that any\u00a0child\u00a0born\u00a0out\u00a0of\u00a0a fasid\u00a0 marriage is \u00a0 entitled \u00a0 to \u00a0 claim \u00a0 a \u00a0 share \u00a0 in \u00a0 his \u00a0 father\u2019s property, the Court held that the plaintiff was entitled to his share in his father\u2019s property.
