{"id":207640,"date":"2019-01-04T19:43:15","date_gmt":"2019-01-04T14:13:15","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=207640"},"modified":"2019-01-11T11:22:15","modified_gmt":"2019-01-11T05:52:15","slug":"criminal-proceeding-under-s-307-ipc-cant-be-quashed-on-the-basis-of-complainant-and-accuseds-settlement","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2019\/01\/04\/criminal-proceeding-under-s-307-ipc-cant-be-quashed-on-the-basis-of-complainant-and-accuseds-settlement\/","title":{"rendered":"Criminal proceeding under S. 307 IPC can\u2019t be quashed on the basis of complainant and accused\u2019s settlement"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Supreme Court<\/strong>: The bench comprising of DY Chandrachud and MR Shah, JJ set aside a Madhya Pradesh High Court order that had quashed the criminal proceedings for the offences under Sections 307, 294 read Section 34 of the IPC solely on the ground that the original Complainant and the accused have settled the dispute and said that the High Court had committed \u201ca grave error\u201d by doing so.<\/p>\n<p style=\"text-align: justify;\">The Court took note of the fact that not only the aforementioned offences were non-compundable but also the allegations against the accused were \u201cvery serious\u201d as allegedly the accused had fired twice on the complainant by a country\u00admade pistol and that one of the accused persons was\u00a0\u00a0 reported to be a hardcore criminal having criminal antecedents.<\/p>\n<p style=\"text-align: justify;\">The Court, hence, noticed:<\/p>\n<p style=\"text-align: justify;\"><em>\u201cthe\u00a0\u00a0 fact\u00a0\u00a0 remains\u00a0\u00a0 that\u00a0\u00a0 the accused\u00a0\u00a0 was\u00a0\u00a0 facing\u00a0\u00a0 the\u00a0\u00a0 criminal\u00a0\u00a0 proceedings\u00a0\u00a0 for\u00a0\u00a0 the\u00a0\u00a0 offences under Sections 307, 294 read with Section 34 of the IPC and that the\u00a0\u00a0 offences\u00a0\u00a0 under\u00a0\u00a0 these\u00a0\u00a0 sections\u00a0\u00a0 are\u00a0\u00a0 not\u00a0\u00a0 non\u00adcompoundable offences\u00a0\u00a0 and,\u00a0\u00a0 looking\u00a0\u00a0 to\u00a0\u00a0 the\u00a0\u00a0 serious\u00a0\u00a0 allegations\u00a0\u00a0 against\u00a0\u00a0 the accused,\u00a0\u00a0 we\u00a0\u00a0 are\u00a0\u00a0 of\u00a0\u00a0 the\u00a0\u00a0 opinion\u00a0\u00a0 that\u00a0\u00a0 the\u00a0\u00a0 High\u00a0\u00a0 Court\u00a0\u00a0 has committed a grave error in quashing the criminal proceedings for the offences under Sections 307, 294 read with Section 34 of the IPC solely on the ground that the original Complainant and the accused have settled the dispute.\u201d<\/em><\/p>\n<p style=\"text-align: justify;\">In a <a href=\"http:\/\/scconline.com\/DocumentLink\/aUMNV60v\">2011 verdict<\/a>, the Court had held that:<\/p>\n<p style=\"text-align: justify;\"><em>\u201cdespite\u00a0any\u00a0settlement\u00a0between\u00a0the\u00a0Complainant\u00a0on\u00a0the\u00a0one\u00a0hand and\u00a0the\u00a0accused\u00a0on\u00a0the\u00a0other,\u00a0the\u00a0criminal\u00a0proceedings\u00a0for\u00a0the offences\u00a0under\u00a0Section\u00a0307\u00a0of\u00a0the\u00a0IPC\u00a0cannot\u00a0be\u00a0quashed,\u00a0as\u00a0the offence \u00a0 under \u00a0 Section \u00a0 307 \u00a0 is \u00a0 a \u00a0 non\u00adcompoundable \u00a0 offence.\u201d<\/em><\/p>\n<p style=\"text-align: justify;\">Hence, setting aside the High Court order, the Court directed that the criminal case be proceeded further in accordance with law and on its own merits.
