She relied on the order of the Joint Registrar where it was noted that a written statement was filed but returned under office objection.<\/p>\n<p style=\"text-align: justify;\">The High Court took note of the admitted fact that defendants have filed a written statement. Reference was made to\u00a0<em>Indian Statistical Institute v. Associate Builders,\u00a0<\/em><a href=\"http:\/\/scconline.com\/DocumentLink\/KGl0W82g\">(1978) 1 SCC 483<\/a> and it was observed to be a settled legal position that delay in\u00a0<em>re-filing\u00a0<\/em>has to be considered on a different footing. Contention put forward by N. Prabhakar and Dhruv Sharma, Advocates for plaintiffs that re-filing tantamount to fresh filing did not find favour with the Court. Accordingly, the appeal was allowed.
