{"id":207249,"date":"2018-12-26T15:30:37","date_gmt":"2018-12-26T10:00:37","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=207249"},"modified":"2018-12-26T13:36:23","modified_gmt":"2018-12-26T08:06:23","slug":"government-order-allowing-interception-and-monitoring-of-data-challenged-in-sc","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2018\/12\/26\/government-order-allowing-interception-and-monitoring-of-data-challenged-in-sc\/","title":{"rendered":"Government order allowing interception and monitoring of data challenged in SC"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Concept Note: Ministry of Home Affairs (MHA) <\/strong>in an order on 20-12-2018 gave a power to 10 Central Agencies of \u201cinterception, monitoring and decryption of any information generated, transmitted, received or stored in any computer\u201d.<\/p>\n<p style=\"text-align: justify;\">The said order was given in exercise of the powers under Section 69 (1) of the IT Act, 2000 read with Rule 4 of the Information Technology (Procedure and Safeguards for Interception, Monitoring and Decryption of Information) Rules, 2009.<\/p>\n<p style=\"text-align: justify;\">Further the stated agencies that have been given the power are:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Intelligence Bureau;<\/li>\n<li>Narcotics Control Bureau;<\/li>\n<li>Enforcement Directorate;<\/li>\n<li>Central Board of Direct Taxes;<\/li>\n<li>Directorate of Revenue Intelligence;<\/li>\n<li>Central Bureau of Investigation;<\/li>\n<li>National Investigation Agency;<\/li>\n<li>Cabinet Secretariat (RAW);<\/li>\n<li>Directorate of Signal Intelligence (For service areas of J&amp;K, North-East and Assam only);<\/li>\n<li>Commissioner of Police, Delhi<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">All of the above information states that \u201cnot just calls or emails, but any data found on a computer can be intercepted. The agencies will also have powers to seize the devices.\u201d<\/p>\n<p style=\"text-align: justify;\"><strong>Advocate ML Sharma has challenged the said order in the Supreme Court of India on grounds
