Jammu & Kashmir <\/span><\/span>High Court:<\/span><\/span><\/strong> A <\/span><\/span>Single Judge B<\/span><\/span>ench comprising of <\/span><\/span>Sanjay Kumar Gupta, J. <\/span><\/span>quashed an FIR <\/span><\/span>for<\/span><\/span>rape, <\/span><\/span>holding the same to be guided by ulterior motive of settling personal grudges<\/span><\/span>.<\/span><\/span><\/p>\n

Petitioner, who was proposed to be married to <\/span><\/span>respondent 2 were<\/span><\/span> refused for marriage when he <\/span><\/span>came to know <\/span><\/span>of her <\/span><\/span>love affair <\/span><\/span>and physical relationship with someone else<\/span><\/span>. <\/span><\/span>Respondent\u2019s<\/span><\/span> parents <\/span><\/span>insisted<\/span><\/span> for marriage and threatened <\/span><\/span>to implicate <\/span><\/span>him<\/span><\/span> for <\/span><\/span>their daughter\u2019s rape<\/span><\/span>.<\/span><\/span> FIR was registered against the petitioner <\/span><\/span>under Sections 376 <\/span><\/span>of the Ranbir Penal Code, 1932 <\/span><\/span>alleging that <\/span><\/span>he<\/span><\/span> subjected respondent 2 <\/span><\/span>to sexual assault on the <\/span><\/span>false promise of marriage. Aggrieved thereby, the instant petit<\/span><\/span>ion was filed.<\/span><\/span><\/p>\n

The Court, on reading the contents of respondent \u00a02\u2019s complaint, noted that a<\/span><\/span> bare perusal <\/span><\/span>thereof showed <\/span><\/span>that<\/span><\/span> there w<\/span><\/span>as <\/span><\/span>no <\/span><\/span>specific mention of date,<\/span><\/span> time and place of alleged rape. General <\/span><\/span>allegations <\/span><\/span>of sexual relationship <\/span><\/span>had been leveled<\/span><\/span> against the petitioner <\/span><\/span>on the ground that <\/span><\/span>he had<\/span><\/span>promised to marry <\/span><\/span>respondent 2.<\/span><\/span><\/p>\n

It was observed that <\/span><\/span>under <\/span><\/span>Section 375(4) <\/span><\/span>RPC <\/span><\/span>inducement is a necessary ingredient <\/span><\/span>in obtaining consent by fraud<\/span><\/span>. <\/span><\/span>T<\/span><\/span>here should be some material o<\/span><\/span>n record <\/span><\/span>prima facie<\/span><\/span> showing<\/span><\/span> that the girl was induced by accused to such an extent that she was ready to have sexual intercourse with him. Promise to marry cannot be said to be an inducement in a<\/span><\/span>ll cases. <\/span><\/span>Where there is mer<\/span><\/span>e breach of promise of marriage<\/span><\/span> and before breach <\/span><\/span>there is a<\/span><\/span> sexual relationship, <\/span><\/span>that relation is a consensual relationship<\/span><\/span>and not rape as defined in S<\/span><\/span>ection 376 RPC.<\/span><\/span><\/p>\n

The Court remarked that <\/span><\/span>\u201c<\/span><\/span>n<\/span><\/span>ow-a-days there are cases where boy and girl having love affair, indulging into sexual relationship and ultimately ending into a breakup. Undoubtedly that amounts to consensual sexual relationship as the<\/span><\/span>y were in love with each other<\/span><\/span>……<\/span><\/span>When a woman is major and educated, she is supposed to be fully aware of the consequences of having sexual intercourse with a man before marriage.\u201d<\/span><\/span><\/p>\n

Relying<\/span><\/span> on the judgment in <\/span><\/span>Vineet Kumar v. State of <\/span><\/span><\/em>Uttar Pradesh<\/em>, (2017) 13 SCC 369<\/a><\/span><\/span> it was<\/span><\/span> held that allegations made in the FIR, even if taken at face<\/span><\/span> value <\/span><\/span>and accepted in their entirety<\/span><\/span>,<\/span><\/span> did <\/span><\/span>not prima facie constitute any offence against the <\/span><\/span>petitioner<\/span><\/span>. As such, the petition was allowed.<\/span><\/span>[<\/span><\/span>Sunil Kumar v.
