{"id":206920,"date":"2018-12-18T08:00:28","date_gmt":"2018-12-18T02:30:28","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=206920"},"modified":"2018-12-18T09:28:55","modified_gmt":"2018-12-18T03:58:55","slug":"reneging-on-a-promise-of-marriage-does-not-render-a-consensual-sexual-relationship-as-rape-jk-hc-quashes-malicious-fir-filed-to-wreak-vengeance-on-the-accused","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2018\/12\/18\/reneging-on-a-promise-of-marriage-does-not-render-a-consensual-sexual-relationship-as-rape-jk-hc-quashes-malicious-fir-filed-to-wreak-vengeance-on-the-accused\/","title":{"rendered":"Reneging on a promise of marriage does not render a consensual sexual relationship as rape: J&#038;K HC quashes malicious FIR filed to wreak vengeance on the accused"},"content":{"rendered":"<p class=\"s3\" style=\"text-align: justify;\"><strong><span class=\"s2\"><span class=\"bumpedFont15\">Jammu &amp; Kashmir <\/span><\/span><span class=\"s2\"><span class=\"bumpedFont15\">High Court:<\/span><\/span><\/strong><span class=\"s4\"><span class=\"bumpedFont15\"> A <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Single Judge B<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">ench comprising of <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Sanjay Kumar Gupta, J. <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">quashed an FIR <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">for<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">rape, <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">holding the same to be guided by ulterior motive of settling personal grudges<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">.<\/span><\/span><\/p>\n<p class=\"s3\" style=\"text-align: justify;\"><span class=\"s4\"><span class=\"bumpedFont15\">Petitioner, who was proposed to be married to <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">respondent 2 were<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> refused for marriage when he <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">came to know <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">of her <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">love affair <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">and physical relationship with someone else<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">. <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Respondent\u2019s<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> parents <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">insisted<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> for marriage and threatened <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">to implicate <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">him<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> for <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">their daughter\u2019s rape<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">.<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> FIR was registered against the petitioner <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">under Sections 376 <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">of the Ranbir Penal Code, 1932 <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">alleging that <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">he<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> subjected respondent 2 <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">to sexual assault on the <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">false promise of marriage. Aggrieved thereby, the instant petit<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">ion was filed.<\/span><\/span><\/p>\n<p class=\"s3\" style=\"text-align: justify;\"><span class=\"s4\"><span class=\"bumpedFont15\">The Court, on reading the contents of respondent \u00a02\u2019s complaint, noted that a<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> bare perusal <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">thereof showed <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">that<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> there w<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">as <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">no <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">specific mention of date,<\/span><\/span> <span class=\"s4\"><span class=\"bumpedFont15\">time and place of alleged rape. General <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">allegations <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">of sexual relationship <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">had been leveled<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> against the petitioner <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">on the ground that <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">he had<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">promised to marry <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">respondent 2.<\/span><\/span><\/p>\n<p class=\"s3\" style=\"text-align: justify;\"><span class=\"s4\"><span class=\"bumpedFont15\">It was observed that <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">under <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Section 375(4) <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">RPC <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">inducement is a necessary ingredient <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">in obtaining consent by fraud<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">. <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">T<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">here should be some material o<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">n record <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">prima facie<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> showing<\/span><\/span> <span class=\"s4\"><span class=\"bumpedFont15\">that the girl was induced by accused to such an extent that she was ready to have sexual intercourse with him. Promise to marry cannot be said to be an inducement in a<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">ll cases. <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Where there is mer<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">e breach of promise of marriage<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> and before breach <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">there is a<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> sexual relationship, <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">that relation is a consensual relationship<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">and not rape as defined in S<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">ection 376 RPC.<\/span><\/span><\/p>\n<p class=\"s3\" style=\"text-align: justify;\"><span class=\"s4\"><span class=\"bumpedFont15\">The Court remarked that <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">\u201c<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">n<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">ow-a-days there are cases where boy and girl having love affair, indulging into sexual relationship and ultimately ending into a breakup. Undoubtedly that amounts to consensual sexual relationship as the<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">y were in love with each other<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">&#8230;&#8230;<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">When a woman is major and educated, she is supposed to be fully aware of the consequences of having sexual intercourse with a man before marriage.\u201d<\/span><\/span><\/p>\n<p class=\"s3\" style=\"text-align: justify;\"><span class=\"s4\"><span class=\"bumpedFont15\">Relying<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> on the judgment in <\/span><\/span><em><span class=\"s5\"><span class=\"bumpedFont15\">Vineet Kumar v. State of <\/span><\/span><\/em><span class=\"s5\"><span class=\"bumpedFont15\"><em>Uttar Pradesh<\/em>, <a href=\"http:\/\/scconline.com\/DocumentLink\/qofsbc61\">(2017) 13 SCC 369<\/a><\/span><\/span> <span class=\"s4\"><span class=\"bumpedFont15\">it was<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> held that allegations made in the FIR, even if taken at face<\/span><\/span> <span class=\"s4\"><span class=\"bumpedFont15\">value <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">and accepted in their entirety<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">,<\/span><\/span> <span class=\"s4\"><span class=\"bumpedFont15\">did <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">not prima facie constitute any offence against the <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">petitioner<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">. As such, the petition was allowed.<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">[<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Sunil Kumar v.
