Patna<\/strong> High Court:<\/strong> A Single judge bench comprising of Anil Kumar Upadhyay, J. dismissed a petition filed for a direction to State authority to correct date of birth in the matriculation certificate, holding that the petition was devoid of merits.<\/p>\n

The instant writ petition was filed seeking a direction to the respondent for correction in of petitioner\u2019s date of birth in his Matriculation certificate and the entry of his date of birth in his service book.<\/p>\n

The Court noted that the petitioner had initiated the present proceedings for correction in his date of birth after more than three decades of the issuance of his matriculation certificate.<\/p>\n

The\u00a0 High Court held that ordinarily, matriculation certificate is taken as the basis for determination of date of birth and if the petitioner\u2019s date of birth was wrongly mentioned in his matriculation certificate, he ought to have approached the Bihar School Examination Bihar for the said correction at the earliest and not at the fag end of his service.<\/p>\n

Additionally, the Court noted that for the last several dates no one had entered the appearance on behalf of the petitioner. As such, the Court had reason to believe that he had lost his interest in pursuing the present proceedings.<\/p>\n

Considering the fact that petitioner had made a prayer for correction in the Matriculation certificate at the fag end of his service, the Court did not find it appropriate to grant any indulgence to him and accordingly dismissed the present writ petition.[Bindeshwar Lal v.
