{"id":198666,"date":"2018-07-18T13:41:44","date_gmt":"2018-07-18T08:11:44","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=198666"},"modified":"2018-07-25T18:03:19","modified_gmt":"2018-07-25T12:33:19","slug":"power-of-the-state-to-lay-down-criteria-for-determination-of-linguistic-minority-not-arbitrary-karnataka-hc","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2018\/07\/18\/power-of-the-state-to-lay-down-criteria-for-determination-of-linguistic-minority-not-arbitrary-karnataka-hc\/","title":{"rendered":"Power of the State to lay down criteria for determination of linguistic minority, not arbitrary: Karnataka HC"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Karnataka High Court: <\/strong>A Division Bench comprising of H.G.Ramesh and Mohammad Nawaz JJ., decided on a Writ Petition filed under Article 226 of the Constitution of India seeking to quash the proviso to clause 2.2 relating to \u2018linguistic minority\u2019 of chapter 4 of the Karnataka State Information Bulletin UG NEET 2018.<\/p>\n<p style=\"text-align: justify;\">The facts in the present case state that the above-mentioned Clause 2.2 which specifies the criteria to determine a candidate\u2019s categorization in the \u2018linguistic minority\u2019 group is violative of Articles 14, 29 and 30 of the Constitution of India.<\/p>\n<p style=\"text-align: justify;\">The grievance of the petitioner was that of not being considered in the \u2018Telugu Linguistic Minority\u2019 in Karnataka. The criteria to claim linguistic minority was to have completed 10 years of study which in the opinion of the petitioner was \u2018arbitrary and unreasonable\u2019 and violative of Articles 14, 29 and 30 of the Constitution of India.<\/p>\n<p style=\"text-align: justify;\">While noting the submissions of the parties, the High Court stated that \u2018In law, for a person to claim the status of belonging to a <strong><em>linguistic minority <\/em><\/strong>in a State, he shall ordinarily be a resident of that State. Residence does not mean a temporary residence; therefore, State will be within its power to lay down reasonable criteria in that behalf.\u2019 The Writ petition was dismissed following the observation of the High Court on finding no merits.
