{"id":198482,"date":"2018-07-12T16:37:17","date_gmt":"2018-07-12T11:07:17","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=198482"},"modified":"2018-08-02T16:22:22","modified_gmt":"2018-08-02T10:52:22","slug":"day-3-section-377-constitution-bench-heading-towards-the-end-of-social-stigma-against-lgbtq","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2018\/07\/12\/day-3-section-377-constitution-bench-heading-towards-the-end-of-social-stigma-against-lgbtq\/","title":{"rendered":"[Day 3] Section 377 | Constitution Bench heading towards the end of social stigma against LGBTQ?"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Supreme Court: <\/strong>The 5-Judge Constitution Bench comprising of CJ Dipak Misra, Rohinton Nariman, A.M Khanwillkar, DY Chandrachud and Indu Malhotra, JJ. continue to unravel the path to justice on Section 377 IPC, 1860 on the third day of the proceedings.<\/p>\n<p style=\"text-align: justify;\">Senior Advocate Shyam Divan resumed with his arguments representing \u2018Voices against 377\u2019 and started with the explanation towards the <strong>positive dimension of Article 14<\/strong> of the Constitution of India. By placing reliance on Nariman, J. judgment on Triple Talaq, <strong><em>Shayara Bano v. Union of India<\/em><\/strong>; <a href=\"http:\/\/www.scconline.com\/DocumentLink\/UUSuxbTP\">(2017) 9 SCC 1<\/a> which states \u201cequality before the law\u201d in Article 14 derived from the UK while \u201cequal protection of the law\u201d is from the 14<sup>th<\/sup> amendment of US.<\/p>\n<p style=\"text-align: justify;\"><strong><em>\u2018Equal protection of the law\u2019 connotes positive content of Article 14 whereas \u2018Equality before the law\u2019 is the negative aspect.<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Shyam Divan also cited <strong>Lawrence v. Texas<\/strong>, 539 U.S. 558 (2003) &#8211; &#8220;The liberty protected by the Constitution allows homosexual persons the right to choose to enter upon relationships in the confines of their homes and their own private lives and still retain their dignity as free persons&#8221;.<\/p>\n<p style=\"text-align: justify;\">He also backed \u2018Right to Intimacy\u2019 quoting from South African Constitutional Court that the right to privacy covers right to maintain intimate relations unaffected by the law.<\/p>\n<p style=\"text-align: justify;\"><strong><em>\u201cSupreme Court should not have re-criminalized Section 377 (after Delhi HC struck it down) because of the tremendous adverse impact it has\u201d: Senior Advocate Shyam Divan<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Indu Malhotra J. making her stance clear on Section 377 said that <strong><em>\u2018Homosexuals face a lot of pressure from parents, society, etc. That is why they turn into bisexuals; it carries huge social ramifications\u2019.<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\"><strong><em>\u2018It is not just human beings who alone indulge in homosexual acts, many animals also show homosexual behaviour; it is not an aberration but a variation\u2019.<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\"><strong><em>\u2018This community of LGBT feels inhibited to go for medical aid due to the prejudices against them.\u2019<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">CJ Dipak Misra observed<strong> <em>\u2018LGBT themselves feel discriminated because of they are treated differently. They feel stigma because of criminality attached to it.&#8217;<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Chandrachud, J. &#8216;<strong><em>We have created a societal environment that creates a discrimination of these individuals. If Section 377 goes let\u2019s hope such societal stigmas change.\u2019<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Senior Advocate C U Singh backed his arguments by stating that having faced criminalisation for over 160 years, it is a huge step to strike it down.<\/p>\n<p style=\"text-align: justify;\">\u2018But whenever there has been historical deep-rooted discrimination, then the State has resorted to affirmative action.\u2019<\/p>\n<p style=\"text-align: justify;\">Further, while concluding his arguments, he stated that \u201cThey (LGBT) continue to suffer a disproportionate mental problem because of the stigma attached to it.\u201d<\/p>\n<p style=\"text-align: justify;\">Senior Advocate Ashok Desai began by stating that existence of LGBT community is a part of our culture hence not alien to Indian culture. While talking about the \u2018stigma\u2019 he cited an article written by late Leila Seth, J. whose son is a homosexual for whom she said that <strong>my son is a criminal as per law<\/strong> after the Delhi HC verdict was reversed by the Supreme Court.<\/p>\n<p style=\"text-align: justify;\"><strong><em>\u2018Homosexuality is existing in society and civilisation has accepted this.\u2019<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\"><strong><em>\u2018Same-sex is not selfish. They don\u2019t want to produce children.\u2019<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">He also argued that the Court needs to recognise the concept of fraternity as the LGBT community is humiliated terribly.<\/p>\n<p style=\"text-align: justify;\">Mr. K. Venugopal submitted that fear of law is used to harass LGBT community. He also states that Section 377 is used as an excuse to impinge on freedom of expression.<\/p>\n<p style=\"text-align: justify;\"><em>\u201c<strong>Section 377 offers a legal basis to suppress alternate sexuality.\u201d<\/strong><\/em><\/p>\n<p style=\"text-align: justify;\">While submitting his arguments, he also stated that Lord Macaulay while introducing this provision said he does not even want to discuss this provision as according to him it was revolting and odious. On concluding his arguments he cited <strong>Lawrence v. Texas<\/strong>, 539 U.S. 558 (2003), the United States Supreme Court judgment which made same-sex marriage in USA legal.<\/p>\n<p style=\"text-align: justify;\">ASG Tushar Mehta appearing for Union of India states that, <strong><em>K.S. Puttaswamy v. Union of India<\/em><\/strong>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/UUSuxbTP\">(2017) 10 SCC 1<\/a> cannot be interpreted to mean that Section 377 should exclude bestiality.<\/p>\n<p style=\"text-align: justify;\">Mehta urged the Court to stick to the constitutionality of Section 377.<\/p>\n<p style=\"text-align: justify;\">CJ Dipak Misra: \u2018<strong><em>Court does not follow majoritarian morality but constitutional morality<\/em><\/strong>.\u2019<\/p>\n<p style=\"text-align: justify;\"><strong><em>&#8220;We don&#8217;t decide Constitutional issues by referendum&#8221;, CJ Dipak Misra to another counsel who tried to make arguments based on &#8220;popular opinion&#8221;.<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\"><strong><em>&#8220;Look at some liberal Constitutions. We will point out some countries on the map where you need to look at&#8221;<\/em><\/strong>.
