{"id":197082,"date":"2018-06-16T10:46:40","date_gmt":"2018-06-16T05:16:40","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=197082"},"modified":"2018-07-03T16:01:49","modified_gmt":"2018-07-03T10:31:49","slug":"courts-do-not-have-the-jurisdiction-of-judicial-review-for-the-decisions-of-religious-organizations-unless-the-legal-rights-are-at-stake","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2018\/06\/16\/courts-do-not-have-the-jurisdiction-of-judicial-review-for-the-decisions-of-religious-organizations-unless-the-legal-rights-are-at-stake\/","title":{"rendered":"Courts do not have the jurisdiction of \u2018Judicial Review\u2019 for the decisions&#8217; of religious organizations, unless the legal rights are at stake"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Supreme Court of Canada: <\/strong>The Canadian Supreme Court Bench comprising of McLachlin C.J. and Abella, Moldaver, Karakatsania, Wagner, Gascon, Cote, Brown and Rowe JJ., allowed an appeal while discussing the scope and essence of \u2018Judicial Review\u2019.<\/p>\n<p style=\"text-align: justify;\">The facts of the case were that the Judicial Committee of the Highwood Congregation of Jehovah\u2019s Witnesses (Appellant), had disfellowshipped Randy Wall (Respondent) due to his engagement in a sinful act for which he was considered to be insufficiently repentant. \u00a0The Appeal committee had confirmed the decision of the judicial committee. Further, the Respondent for the purpose of \u2018Judicial review\u2019 of his disfellowship placed an originating application on the basis of it being procedurally unfair before the Queen\u2019s Bench.<\/p>\n<p style=\"text-align: justify;\">Following the facts of the case, the primary issue that was to be answered through was of the jurisdiction of the court\u2019s to review decisions of religious organizations.<\/p>\n<p style=\"text-align: justify;\">While concluding the case, and allowing the appeal, the bench gave an understanding of the concept of \u2018Judicial review\u2019 by explaining that the private parties cannot seek \u2018judicial review\u2019 to solve disputes that may arise between them; rather, their claims must be founded on a valid cause of action, and also stated that the respondent had no cause of action neither did the ecclesiastical issues raised by him were justiciable.<\/p>\n<p style=\"text-align: justify;\">Therefore, the Court, while stating that \u2018Judicial Review\u2019 is only available where there is an exercise of state authority and on an analysis of the stated issues which no where touched the \u2018rule of law\u2019 decided that \u201c<em>Courts may only interfere to address procedural fairness concerns related to the decisions of religious groups or other voluntary associations if legal rights are at stake and the claim is founded on a valid cause of action.\u201d <\/em>The appeal was allowed by quashing the originating application for judicial review as the matter in issue was outside the courts\u2019 jurisdiction.
