{"id":196118,"date":"2018-05-18T18:24:07","date_gmt":"2018-05-18T12:54:07","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=196118"},"modified":"2018-06-01T12:12:40","modified_gmt":"2018-06-01T06:42:40","slug":"absence-of-entries-in-general-diary-concerning-the-preliminary-enquiry-is-not-per-se-illegal-sc","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2018\/05\/18\/absence-of-entries-in-general-diary-concerning-the-preliminary-enquiry-is-not-per-se-illegal-sc\/","title":{"rendered":"Absence of entries in General Diary concerning the preliminary enquiry is not per se illegal: SC"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Supreme Court<\/strong>: Holding that the\u00a0absence\u00a0of\u00a0entries\u00a0in\u00a0the General\u00a0Diary\u00a0concerning\u00a0the\u00a0preliminary\u00a0enquiry\u00a0is not per\u00a0se illegal, the bench of NV Ramana and SA Nazeer said:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">\u201cAs\u00a0the\u00a0concept\u00a0of\u00a0maintaining\u00a0General\u00a0Diary\u00a0has\u00a0its\u00a0origin under\u00a0the\u00a0Section\u00a044\u00a0of\u00a0Police\u00a0Act\u00a0of\u00a01861\u00a0as\u00a0applicable\u00a0to States,\u00a0which\u00a0makes\u00a0it\u00a0an\u00a0obligation\u00a0for\u00a0the\u00a0concerned\u00a0Police Officer to maintain a General Diary, but such non-maintenance per se may not be rendering the whole prosecution illegal.\u201d<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">The Court noticed that <em>CrPC itself\u00a0has\u00a0differentiated\u00a0between\u00a0irregularity\u00a0and\u00a0illegality<\/em>. The\u00a0obligation\u00a0of\u00a0maintenance\u00a0of\u00a0General\u00a0Diary\u00a0is\u00a0part\u00a0of course\u00a0of\u00a0conduct\u00a0of\u00a0the\u00a0concerned\u00a0officer,\u00a0which\u00a0may\u00a0not itself\u00a0have\u00a0any\u00a0bearing\u00a0on\u00a0the\u00a0criminal\u00a0trial\u00a0unless\u00a0some grave\u00a0prejudice\u00a0going\u00a0to\u00a0the\u00a0root\u00a0of\u00a0matter\u00a0is\u00a0shown\u00a0to\u00a0exist at the time of the trial.<\/p>\n<p style=\"text-align: justify;\">The Court, however, rejected the notion that maintaining the General Diary is not necessary and held that if the Officer has not recorded,\u00a0then\u00a0it\u00a0is\u00a0for\u00a0the\u00a0trial\u00a0court\u00a0to\u00a0weigh\u00a0the\u00a0effect\u00a0of the\u00a0same\u00a0for\u00a0reasons\u00a0provided\u00a0therein.\u00a0It said:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">\u201cwe are aware\u00a0of\u00a0the\u00a0fact\u00a0that\u00a0such\u00a0non-maintenance\u00a0of\u00a0General Diary\u00a0may\u00a0have\u00a0consequences\u00a0on\u00a0the\u00a0merits\u00a0of\u00a0the\u00a0case, which\u00a0is\u00a0a\u00a0matter\u00a0of\u00a0trial.\u00a0Moreover,\u00a0we\u00a0are\u00a0also\u00a0aware\u00a0of\u00a0the fact\u00a0that\u00a0the\u00a0explanation\u00a0of\u00a0the\u00a0genesis\u00a0of\u00a0a\u00a0criminal\u00a0case,\u00a0in some \u00a0 cases, plays\u00a0an important role in establishing the prosecution\u2019s case.\u201d<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">[State v.
