Rajasthan High Court:<\/strong> A Division Bench comprising of G.K. Vyas and G.R. Moolchandani, JJ. declined to quash the Advisory issued by the Information and Broadcasting Ministry constraining the telecast of condom advertisements between 10:00 pm and 6:00 am.<\/p>\n

The petition was filed under the label of public interest litigation (PIL) praying to the Court to quash the above-mentioned government advisory. The petitioner sought such relief in the interest of general public.<\/p>\n

After considering the Advisory concerned and having regard to the submissions made on behalf of the petitioner, the High Court held that it was the duty of the legislature to regulate such advertisement of condoms. In exercise of such duty, some rules were framed by the government in the form of an advisory. Therefore, the Court held that, no such relief as prayed for by the petitioner could be granted.
