{"id":195921,"date":"2018-05-09T16:33:41","date_gmt":"2018-05-09T11:03:41","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=195921"},"modified":"2018-05-23T14:56:44","modified_gmt":"2018-05-23T09:26:44","slug":"parliamentary-committee-reports-can-be-taken-judicial-notice-of-but-its-validity-cant-be-questioned-sc","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2018\/05\/09\/parliamentary-committee-reports-can-be-taken-judicial-notice-of-but-its-validity-cant-be-questioned-sc\/","title":{"rendered":"Parliamentary Committee Report can be taken judicial notice of but it\u2019s validity can\u2019t be questioned: SC"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Supreme Court<\/strong>: Writing down a 338-page-long verdict, the 5-judge Constitution Bench of Dipak Misra, CJ and AM Khanwilkar, Dr. DY Chandrachud, Dr. AK Sikri and Ashok Bhushan, JJ held:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">\u201cParliamentary Standing Committee Report or any Parliamentary Committee Report can be taken judicial notice of and regarded as admissible in evidence, but it can neither be impinged nor challenged nor its validity can be called in question.\u201d<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\"><strong>CJI, writing for himself and Khanwilkar, J said<\/strong>:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">\u201cThe Constitution itself being a dynamic, lively and ever-changing document adapts to the paradigm of epochs. That being the situation, it is also for this Court to take a fresh look and mould the existing precepts to suit the new emerging situations.\u201d<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">He further concluded:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Where the fact is contentious, the petitioner can always collect the facts from many a source and produce such facts by way of affidavits, and the Court can render its verdict by way of independent adjudication.<\/li>\n<li>The Parliamentary Standing Committee report being in the public domain can invite fair comments and criticism from the citizens as in such a situation, the citizens do not really comment upon any member of the Parliament to invite the hazard of violation of parliamentary privilege.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>Chandrachud, J, writing for himself and Sikri, J said<\/strong>:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">\u201cAs a matter of principle, there is no reason or justification to exclude the report of a Parliamentary Standing Committee from the purview of the judicial process, for purposes such as understanding the historical background of a law, the nature of the problem, the causes of a social evil and the remedies which may provide answers to intractable problems of governance.\u201d<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">He, however, added that <em>no Member of Parliament or person can be made liable for what is stated in the course of the proceedings before a Parliamentary Committee or for a vote tendered or given.<\/em><\/p>\n<p style=\"text-align: justify;\"><strong>Bhushan, J, in his detailed judgment explained <\/strong><em>that the Parliamentary Committee Reports cannot\u00a0 be\u00a0 treated\u00a0 as\u00a0 conclusive\u00a0 or binding of what has been concluded in the Report<\/em>. He said:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">\u201cBy\u00a0acceptance\u00a0of\u00a0a\u00a0Parliamentary Committee\u00a0Report\u00a0in\u00a0evidence\u00a0does\u00a0not\u00a0mean\u00a0that\u00a0facts stated\u00a0in\u00a0the\u00a0Report\u00a0stand\u00a0proved.\u00a0When\u00a0issues,\u00a0facts come\u00a0before\u00a0a\u00a0Court\u00a0of\u00a0law\u00a0for\u00a0adjudication,\u00a0the\u00a0Court is\u00a0to\u00a0decide\u00a0the\u00a0issues\u00a0on\u00a0the\u00a0basis\u00a0of\u00a0evidence\u00a0and materials\u00a0brought\u00a0before\u00a0it\u00a0and\u00a0in\u00a0which\u00a0adjudication Parliamentary\u00a0Committee\u00a0Report\u00a0may\u00a0only\u00a0be\u00a0one\u00a0of\u00a0the materials,\u00a0what\u00a0weight\u00a0has\u00a0to\u00a0be\u00a0given\u00a0to\u00a0one\u00a0or\u00a0other evidence \u00a0 is \u00a0 the \u00a0 adjudicatory \u00a0 function \u00a0 of \u00a0 the \u00a0 Court which\u00a0may\u00a0differ\u00a0from\u00a0case\u00a0to\u00a0case.\u201d<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">[Kalpana Mehta v.
