Rajya Sabha Chairman Venkaiah Naidu has rejected the impeachment motion against Chief Justice of India Dipak Misra<\/a>, moved by 7 opposition parties. The impeachment notice had come a day after the Supreme Court rejected a batch of petitions seeking an independent probe into the death of Judge B H Loya, who was hearing the Sohrabuddin Sheikh encounter case. Signatures of 64 lawmakers from seven parties were submitted on Friday.<\/div>\n
The order passed by Shri Naidu states,<\/div>\n
\n
\u201cThe motion presented by the MPs indicates a mere suspicion, conjecture or an assumption in the Prasad Education Trust case. The same does not constitute proof beyond a reasonable doubt required to make out a case of proved misbehavior.\u201d<\/div>\n
The order said the conversations between third parties with dubious credentials cannot themselves constitute material evidence against CJI.<\/div>\n
“Going through the allegations mentioned in the notice, I am of the view they are neither tenable nor admissable. The allegations emerging from the case have a serious tendency of undermining the independence of the judiciary, which is the basic tenet of the Constitution of India.”<\/div>\n
The order further said,<\/div>\n
I am \u00a0of the clear\u00a0 opinion\u00a0 that\u00a0 all\u00a0 facts,\u00a0 as\u00a0 in \u00a0the motion, \u00a0read\u00a0 with the context \u00a0of \u00a0the\u00a0 annexed documents, do not make out a \u00a0case\u00a0 \u00a0under Article 124 (4) of the \u00a0Constitution\u00a0 \u00a0which can lead \u00a0any \u00a0reasonable \u00a0mind\u00a0 \u00a0to\u00a0 conclude that\u00a0\u00a0 \u00a0the\u00a0 \u00a0Chief\u00a0 \u00a0Justice\u00a0 \u00a0of \u00a0India\u00a0 \u00a0on\u00a0 \u00a0these\u00a0 facts can\u00a0 be \u00a0ever\u00a0 \u00a0held\u00a0 \u00a0guilty\u00a0 of “misbehaviour”.<\/div>\n
Shri Naidu further noted,<\/div>\n
“As\u00a0 \u00a0heirs\u00a0 to an illustrious democratic tradition and custodians of the present and future of democratic \u00a0polity, we \u00a0should, in\u00a0 my view, collectively\u00a0 strengthen\u00a0 \u00a0and\u00a0 \u00a0not\u00a0 \u00a0erode the\u00a0 \u00a0foundations\u00a0 \u00a0of \u00a0the\u00a0 \u00a0grand edifice bequeathed to us by the Constitution makers. We cannot allow \u00a0any of our \u00a0pillars of governance \u00a0to be weakened by any \u00a0thought, \u00a0word, \u00a0or action.”<\/div>\n
