Chelameswar and Sanjay Kishan Kaul, JJ held that the\u00a0expression\u00a0\u201callowances\u201d\u00a0of\u00a0MPs\u00a0occurring\u00a0under\u00a0Entry\u00a073 of\u00a0List \u00adI\u00a0of\u00a0the\u00a0Seventh\u00a0Schedule is\u00a0wide\u00a0enough\u00a0to cover\u00a0the\u00a0payment\u00a0of\u00a0\u201cpension\u201d\u00a0and\u00a0the\u00a0other\u00a0benefits\u00a0covered\u00a0by the\u00a0impugned\u00a0provisions\u00a0to\u00a0MPs\u00a0or\u00a0ex\u00ad-MPs.\u00a0Even\u00a0otherwise\u00a0the authority\u00a0of\u00a0Parliament\u00a0under\u00a0Entry\u00a097\u00a0of\u00a0List \u00adI\u00a0is\u00a0wide\u00a0enough\u00a0to cover\u00a0the\u00a0impugned\u00a0legislation.<\/p>\n<p style=\"text-align: justify;\">Regarding the contention that the silence\u00a0in Article\u00a0106\u00a0of the Constitution operates as\u00a0a prohibition for\u00a0payment of pension\u00a0to\u00a0the\u00a0former\u00a0MP, the Court said:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">\u201cThe\u00a0fact\u00a0that\u00a0there\u00a0are\u00a0express\u00a0references\u00a0to\u00a0the\u00a0payment\u00a0of pension\u00a0in\u00a0the\u00a0Constitution\u00a0for\u00a0certain\u00a0Constitutional\u00a0functionaries and\u00a0not\u00a0for\u00a0others,\u00a0in\u00a0our\u00a0opinion\u00a0does\u00a0not\u00a0lead\u00a0to\u00a0the\u00a0conclusion that \u00a0 the \u00a0 Constitution by its silence prohibits the payment of pension\u00a0to\u00a0those\u00a0constitutional\u00a0functionaries.\u201d<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">It further said:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">\u201cif we were to accept the argument that those Constitutional\u00a0functionaries\u00a0who\u00a0are\u00a0entitled\u00a0to\u00a0pension\u00a0by\u00a0the\u00a0text of\u00a0the\u00a0Constitution\u00a0form\u00a0a\u00a0distinct\u00a0class\u00a0exclusively\u00a0entitled\u00a0to\u00a0the payment of pension the result would be that the CAG, the Chairman and Deputy Chairman of the\u00a0Parliament or State Legislature, and Ministers of the Centre and State would be disentitled\u00a0to\u00a0pension.\u201d<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">The petitioner also argued that\u00a0pension is\u00a0payable\u00a0to\u00a0an\u00a0employee\u00a0of\u00a0State\u00a0after\u00a0his\u00a0superannuation.\u00a0\u00a0Since MPs\u00a0are\u00a0not\u00a0employees\u00a0of\u00a0State,\u00a0they\u00a0are\u00a0not\u00a0entitled\u00a0for\u00a0pension nor\u00a0the\u00a0Parliament\u00a0is\u00a0competent\u00a0to\u00a0provide\u00a0payment\u00a0of\u00a0pension\u00a0to the \u00a0 ex\u00adMPs. Rejecting the said argument, the Court said that presuming that pension\u00a0is\u00a0only\u00a0payable\u00a0to former\u00a0employees\u00a0of\u00a0State\u00a0and\u00a0nobody\u00a0else, is erroneous as there\u00a0are\u00a0various\u00a0other\u00a0categories\u00a0of\u00a0payments\u00a0made\u00a0by State\u00a0which\u00a0are\u00a0called\u00a0\u2018pensions\u2019,\u00a0such\u00a0as,\u00a0Old\u00a0Age\u00a0Pension,\u00a0Widow Pension,\u00a0and\u00a0Disability\u00a0Pension\u00a0etc.<\/p>\n<p style=\"text-align: justify;\">The Court, however, ended the judgment by stating that:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">\u201cthese questions\u00a0are\u00a0in\u00a0the\u00a0orbit\u00a0of\u00a0the wisdom of the Parliament in choosing\/changing the legislative policy\u00a0whether\u00a0the\u00a0various\u00a0benefits\u00a0created\u00a0under\u00a0the\u00a0impugned provisions\u00a0are\u00a0rational\u00a0having\u00a0regard\u00a0to\u00a0the\u00a0affluent\u00a0financial\u00a0status of\u00a0some\u00a0of\u00a0the\u00a0MPs\u00a0or\u00a0the\u00a0poverty\u00a0of\u00a0the\u00a0millions\u00a0of\u00a0the\u00a0population etc.\u201d<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">[Lok Prahari v.
