{"id":195177,"date":"2018-04-11T17:35:10","date_gmt":"2018-04-11T12:05:10","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=195177"},"modified":"2018-04-11T17:35:10","modified_gmt":"2018-04-11T12:05:10","slug":"consent-already-manifest-in-hindu-marriage-act-no-interference-warranted-sc","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2018\/04\/11\/consent-already-manifest-in-hindu-marriage-act-no-interference-warranted-sc\/","title":{"rendered":"Consent already manifest in Hindu Marriage Act; No interference warranted: SC"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Supreme Court:<\/strong>\u00a0The Bench of Dipak Misra, CJ and AM Khanwilkar and Dr. DY Chandrachud, JJ refused to interfere with the provisions of the Hindu Marriage Act, 1955 when a 26-year-old Karnataka woman sought direction to make prior consent of a boy or a girl mandatory before marriage under the Hindu Marriage Act. The Court said that the concept of consent is already present in the Act and it does not warrant the interference of the Court.\u00a0The bench observed that the Section 12C of the\u00a0Hindu Marriage Act\u00a0provides for annulment of\u00a0marriage\u00a0if there is forced or fraudulent\u00a0consent.<\/p>\n<p style=\"text-align: justify;\">The\u00a0woman, who is the daughter of a\u00a0Karnataka\u00a0politician had fled to Delhi from her wedding ceremony as she did not approve of the\u00a0marriage.
