{"id":195136,"date":"2018-04-10T10:31:29","date_gmt":"2018-04-10T05:01:29","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=195136"},"modified":"2018-04-13T15:13:05","modified_gmt":"2018-04-13T09:43:05","slug":"hadiyas-father-cannot-be-allowed-to-curtail-the-fundamental-rights-of-his-daughter-in-the-name-of-protecting-her-interests-sc-full-report","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2018\/04\/10\/hadiyas-father-cannot-be-allowed-to-curtail-the-fundamental-rights-of-his-daughter-in-the-name-of-protecting-her-interests-sc-full-report\/","title":{"rendered":"Hadiya\u2019s father cannot be allowed to curtail the fundamental rights of his daughter in the name of protecting her interests: SC [Full Report]"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Supreme Court<\/strong>: Terming the Hadiya case as the perfect example of <em>\u201cpatriarchal\u00a0autocracy\u00a0and\u00a0possibly\u00a0self \u00adobsession\u00a0with the\u00a0feeling\u00a0that\u00a0a\u00a0female\u00a0is\u00a0a\u00a0chattel\u201d<\/em>, the 3-judge bench of Dipak Misra, CJ and AM Khanwilkar and Dr. DY Chandrachud, JJ set aside the Kerala High Court verdict and held that the\u00a0High\u00a0Court\u00a0has\u00a0completely\u00a0erred\u00a0by taking\u00a0upon\u00a0itself\u00a0the\u00a0burden\u00a0of\u00a0annulling\u00a0the\u00a0marriage\u00a0between two consenting adults, namely, Hadiya and Shafin Jahan.<\/p>\n<p style=\"text-align: justify;\">Below are the important facts of the case:<\/p>\n<ul style=\"text-align: justify;\">\n<li>24-year-old Akhila alias Hadiya, had converted to Islam after staying with 2 of her friends, Jaseena and Faseena, while completing her Bachelor of Homeopathic Medicine and Surgery (BHMS) degree.<\/li>\n<li>Hadiya refused to return to her father Asokan\u2019s place after he filed a writ of habeas corpus before Kerala High Court in January, 2016 on the apprehension that his daughter was likely to be transported out of the country.<\/li>\n<li>Hadiya continued to stay at the house of her aforementioned friends. She expressed her desire to complete her House \u00a0 Surgeoncy \u00a0 at\u00a0 the\u00a0 Shivaraj Homeopathic \u00a0 Medical \u00a0 College, Salem which has a hostel for women \u00a0 where \u00a0 she \u00a0 was \u00a0 willing \u00a0 to \u00a0 reside \u00a0 for \u00a0 the \u00a0 purpose \u00a0 of completing\u00a0her\u00a0House\u00a0Surgeoncy.<\/li>\n<li>On\u00a021.12.2016,\u00a0Hadiya\u00a0appeared\u00a0before\u00a0the\u00a0High\u00a0Court\u00a0and a\u00a0statement\u00a0was\u00a0made\u00a0that\u00a0she\u00a0had\u00a0entered\u00a0into\u00a0marriage\u00a0with Shafin\u00a0Jahan. High Court noted that the marriage was totally unexpected.<\/li>\n<li>High Court in the impugned judgment held that\u00a0a\u00a0girl\u00a0aged\u00a024\u00a0years\u00a0is\u00a0weak\u00a0and\u00a0vulnerable\u00a0and capable \u00a0 of \u00a0 being \u00a0 exploited \u00a0 in \u00a0 many ways and thereafter, the Court,\u00a0exercising\u00a0the\u00a0parens\u00a0patriae\u00a0jurisdiction,\u00a0observed\u00a0that\u00a0it was\u00a0concerned\u00a0with\u00a0the\u00a0welfare\u00a0of\u00a0the\u00a0girl\u00a0of\u00a0her\u00a0age and hence, the custody\u00a0of\u00a0Akhila\u00a0alias\u00a0Hadiya\u00a0should\u00a0be\u00a0given\u00a0to\u00a0her\u00a0parents.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">The Kerala High Court allowed her to complete her studies but held:<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">\u201cHer\u00a0marriage being\u00a0the\u00a0most\u00a0important\u00a0decision\u00a0in\u00a0her\u00a0life,\u00a0can also\u00a0be\u00a0taken\u00a0only\u00a0with\u00a0the\u00a0active\u00a0involvement\u00a0of\u00a0her parents.\u00a0The\u00a0marriage\u00a0which\u00a0is\u00a0alleged\u00a0to\u00a0have\u00a0been performed\u00a0is\u00a0a\u00a0sham\u00a0and\u00a0is\u00a0of\u00a0no\u00a0consequence\u00a0in the\u00a0eye\u00a0of\u00a0law.\u201d<\/p>\n<p style=\"text-align: justify;\">CJI, writing for himself and Khanwilkar, J, held that non\u00ad-acceptance\u00a0of\u00a0Hadiya\u2019s\u00a0choice\u00a0would\u00a0simply\u00a0mean\u00a0creating discomfort\u00a0to\u00a0the\u00a0constitutional\u00a0right\u00a0by\u00a0a\u00a0Constitutional\u00a0Court which\u00a0is\u00a0meant\u00a0to\u00a0be\u00a0the\u00a0protector\u00a0of\u00a0fundamental\u00a0rights.\u00a0Such\u00a0a situation\u00a0cannot\u00a0remotely\u00a0be\u00a0conceived.<\/p>\n<p style=\"text-align: justify;\">He wrote:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">\u201cThe expos\u00e9\u00a0of\u00a0facts\u00a0in\u00a0the\u00a0present\u00a0case\u00a0depicts\u00a0that\u00a0story\u00a0giving\u00a0it\u00a0a colour\u00a0of\u00a0different\u00a0narrative.\u00a0It\u00a0is\u00a0different\u00a0since\u00a0the\u00a0State\u00a0that\u00a0is expected\u00a0to\u00a0facilitate\u00a0the\u00a0enjoyment\u00a0of\u00a0legal\u00a0rights\u00a0of\u00a0a\u00a0citizen\u00a0has also\u00a0supported\u00a0the\u00a0cause\u00a0of\u00a0a\u00a0father,\u00a0an\u00a0obstinate\u00a0one,\u00a0who\u00a0has endeavoured\u00a0immensely\u00a0in\u00a0not\u00a0allowing\u00a0his\u00a0daughter\u00a0to\u00a0make\u00a0her own\u00a0choice\u00a0in\u00a0adhering\u00a0to\u00a0a\u00a0faith\u00a0and\u00a0further\u00a0making\u00a0Everestine effort\u00a0to\u00a0garrotte\u00a0her\u00a0desire\u00a0to\u00a0live\u00a0with\u00a0the\u00a0man\u00a0with\u00a0whom\u00a0she has\u00a0entered\u00a0into\u00a0wedlock.\u201d<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">Chandrachud, J also came down heavily upon the Kerala High Court for following an erroneous approach and writing down a separate but concurring judgment, said:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">\u201cThe schism between Hadiya and her father may be unfortunate. But it was no part of the jurisdiction of the High Court to decide what it considered to be a \u2018just\u2019 way of life or \u2018correct\u2019 course of living for Hadiya. She has absolute autonomy over her person. Hadiya appeared before the High Court and stated that she was not under illegal confinement. There was no warrant for the High Court to proceed further in the exercise of its jurisdiction under Article 226.\u201d<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">The Court, however, permitted the National Investigation Agency (NIA) to continue the investigation in\u00a0respect\u00a0of\u00a0any\u00a0matter\u00a0of\u00a0criminality. However, the validity of the marriage between Shafin Jahan and Hadiya shall not form the subject matter of the investigation. The Court made it clear that \u201cnothing contained in the interim order of this Court will be construed as empowering the investigating agency to interfere in the lives which the young couple seeks to lead as law abiding citizens.\u201d<\/p>\n<p style=\"text-align: justify;\">The Court had passed the operative order in the present matter on <a href=\"http:\/\/blog.scconline.com\/post\/2018\/03\/08\/kerala-high-courts-judgment-annulling-hadiyas-marriage-set-aside-supreme-court\/\">08.03.2018<\/a>.<\/p>\n<p style=\"text-align: justify;\">[Shafin Jahan v.
