{"id":193891,"date":"2018-03-09T15:19:48","date_gmt":"2018-03-09T09:49:48","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=193891"},"modified":"2018-03-28T23:56:17","modified_gmt":"2018-03-28T18:26:17","slug":"environment-protection-amendment-rules-2018-notified","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2018\/03\/09\/environment-protection-amendment-rules-2018-notified\/","title":{"rendered":"The Environment (Protection) Amendment Rules, 2018 notified"},"content":{"rendered":"<p style=\"text-align: justify;\">The Central Government in exercise of the powers conferred by sections 6 and 25 of the Environment (Protection) Act, 1986 (29 of 1986), has made the Environment (Protection) Amendment Rules, 2018, through G.S.R. 94(E), w.e.f. 25-01-2018, to further amend the Environment (Protection) Rules, 1986.<\/p>\n<p style=\"text-align: justify;\">In the Environment (Protection) Rules, 1986, in Schedule-I, after serial number 105 and the entries relating thereto, the following serial numbers and entries shall be inserted, namely,<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">\u201c106. Mandatory Implementation of Dust Mitigation Measures for Construction and Demolition Activities for projects requiring Environmental Clearance:<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">(i) No building or infrastructure project requiring Environmental Clearance shall be implemented without approved Environmental Management Plan inclusive of dust mitigation measures.<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">(ii) Roads leading to or at construction sites must be paved and blacktopped (i.e. metallic roads).<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">(iii) No excavation of soil shall be carried out without adequate dust mitigation measures in place.<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">(iv) No loose soil or sand or Construction &amp; Demolition Waste or any other construction material that causes dust shall be left uncovered.<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">(v) Wind-breaker of appropriate height i.e. 1\/3rd of the building height and maximum up to 10 meters shall be provided.<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">(vi) Water sprinkling system shall be put in place.<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">(vii) Dust mitigation measures shall be displayed prominently at the construction site for easy public viewing.<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">107. Mandatory Implementation of Dust Mitigation Measures for all Construction and Demolition Activities:<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">(i) Grinding and cutting of building materials in open area shall be prohibited.<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">(ii) Construction material and waste should be stored only within earmarked area and road side storage of construction material and waste shall be prohibited.<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">(iii) No uncovered vehicles carrying construction material and waste shall be permitted.<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">(iv) Construction and Demolition Waste processing and disposal site shall be identified and required dust mitigation measures be notified at the site.<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\"><strong>Note :<\/strong> The serial numbers 106 and 107 above shall apply to cities and towns where value of particulate matter 10\/ particulate matter 2.5 exceeds the prescribed limits in National Ambient Air Quality Standards.\u201d<\/p>\n<p style=\"text-align: justify;\"><strong>Note :<\/strong> The principal rules were published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number S.O. 844(E), dated the 19th November, 1986 and subsequently amended vide the following notifications, namely:\u2014<\/p>\n<p style=\"text-align: justify;\">S.O. 433(E), dated the 18th April, 1987; G.S.R. 176(E), dated the 2nd April, 1996; G.S.R. 97 (E), dated the 18th February, 2009; G.S.R. 149(E), dated the 4th March, 2009; G.S.R. 543(E), dated the 22nd July, 2009; G.S.R. 739(E), dated the 9th September, 2010; G.S.R. 809(E), dated the 4th October, 2010: G.S.R. 215(E), dated the15th March, 2011; G.S.R. 221(E), dated the 18th March, 2011;G.S.R. 354(E), dated the 2nd May, 2011; G.S.R. 424(E), dated the 1st June, 2011; G.S.R.\u00a0446(E), dated the 13th June, 2011; G.S.R. 152(E), dated the 16thMarch, 2012; G.S.R. 266(E), dated the 30th March, 2012; G.S.R. 277 (E), dated the 31st March, 2012;G.S.R. 820 (E), dated the 9th November, 2012; G.S.R. 176(E), dated the 18thMarch, 2013; G.S.R. 535(E), dated the 7thAugust, 2013; G.S.R. 771(E), dated the 11th December, 2013; G.S.R. 2 (E), dated the 2nd January, 2014; G.S.R. 229 (E), dated the 28th March, 2014; G.S.R. 232 (E), dated the 31st March, 2014; G.S.R. 325 (E), dated the 7th May, 2014; G.S.R. 612(E), dated the 25th August, 2014; G.S.R. 789 (E), dated the 11th November, 2014;S.O. 3305 (E), dated the 7th December, 2015; S.O. 4(E), dated the 1st January, 2016; G.S.R. 35(E), dated the 14th January, 2016 G.S.R. 281(E), dated the 7th March, 2016; G.S.R. 496(E), dated the 9th May, 2016, G.S.R. 497(E), dated the 10th May, 2016; G.S.R. 978(E), dated the 10th October, 2016, G.S.R. 1016(E), dated the 28th October, 2016 and lastly amended vide notification GSR 1265(E) dated the 13th October, 2017.<\/p>\n<p style=\"text-align: right;\">[F.
