Karnataka High Court:<\/strong> While deciding a writ appeal, a Single Judge Bench of P.S. Dinesh Kumar, J. was of the view that salary must be paid to the writ petitioner regularly.<\/p>\n

The writ appeal was filed under Section 4 of the Karnataka High Court Act, praying to set aside the order passed by the learned Single Judge, directing the maintenance of status quo considering the fact that the writ petitioner-Respondent 1 continued to work for Respondent 2-State Education Department.<\/p>\n

The writ petitioner was working with Respondent 2 but his salaries were not released. He filed an application seeking for a direction for release of salaries from May 2017. Learned counsel for the appellant submitted that as the State Government did not release the fund, the salary could not be paid to the writ petitioner.<\/p>\n

The High Court did not find any merit in the above said contention of the appellant and was of the view that a person who is discharging his functions must get his salary regularly. The Court did not find any fault with the impugned order and accordingly, the writ appeal was dismissed. [Kuvempu University v.
