{"id":147581,"date":"2017-08-07T14:31:00","date_gmt":"2017-08-07T09:01:00","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=147581"},"modified":"2017-08-07T14:31:00","modified_gmt":"2017-08-07T09:01:00","slug":"excess-payment-made-to-a-retired-employee-cant-be-recovered-from-his-pensionary-benefits-unless-grounds-of-fraud-or-misrepresentation-are-involved","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2017\/08\/07\/excess-payment-made-to-a-retired-employee-cant-be-recovered-from-his-pensionary-benefits-unless-grounds-of-fraud-or-misrepresentation-are-involved\/","title":{"rendered":"Excess payment made to a retired employee can\u2019t be recovered from his pensionary benefits, unless grounds of fraud or misrepresentation are involved"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Calcutta High Court:<\/strong> The writ petition was preferred by a primary school teacher, aggrieved that an amount of Rs. 68, 556 was deducted from the pension payment order by the authorities, due to alleged over-drawl.<\/p>\n<p style=\"text-align: justify;\">Learned counsel on behalf of the petitioner, by relying on the Supreme Court\u2019s decision of <em>Shyam Babu Verma<\/em> v. <em>Union of India,<\/em> <a href=\"http:\/\/www.scconline.com\/LoginForDocumentLink\/f7T12Z63\">(1994) 2 SCC 521<\/a> contends that the excess amount can\u2019t be recovered from the retiral benefit of an employee unless it is due to some fraud or misrepresentation. In the case of <em>Syed Abdul Qadir v. State of Bihar<\/em>, <a href=\"http:\/\/www.scconline.com\/LoginForDocumentLink\/3N4s12l0\">(2009) 3 SCC 475<\/a> the Supreme Court observed that \u201cthe relief against recovery is granted by courts not because of any right in the employees, but in equity, exercising judicial discretion to relieve the employees from the hardship that will be caused if recovery is ordered.\u201d<\/p>\n<p style=\"text-align: justify;\">Therefore, \u00a0Arijit Banerjee, J. quoted the observation of another learned Judge, \u201cthe choice is like choosing between the devil and deep sea\u201d and ordered that, by considering the decisions of the Hon\u2019ble Division Bench in the cases of\u00a0<em>Shyam Babu Verma<\/em>,<em>\u00a0Syed Abdul Qadir,<\/em>\u00a0<em>Chandi Prasad Uniyal<\/em> v. <em>State of Uttarakhand<\/em>, <a href=\"http:\/\/www.scconline.com\/LoginForDocumentLink\/jj2eV8RE\">(2012) 8 SCC 417 <\/a>and <em>State of Punjab<\/em> v.<em> Rafiq Masih<\/em>, <a href=\"http:\/\/www.scconline.com\/LoginForDocumentLink\/4hUgOQXZ\">(2014) 8 SCC 883<\/a> held that no recovery can be made from a retired\u00a0employee who is due to retire within one year from the order of recovery. Further, no recovery could be made in the present case from the retrial benefits of the petitioner even after a delay of 15 years by considering the decision of the case of <em>Union of India<\/em> v. Tarsem <em>Singh,<\/em> (2008) 3 SCC 648, as it did not affect the third party rights. [Jaynal Alam v.
