{"id":143891,"date":"2017-07-21T19:42:30","date_gmt":"2017-07-21T14:12:30","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=143891"},"modified":"2017-07-27T14:53:32","modified_gmt":"2017-07-27T09:23:32","slug":"mental-age-of-a-person-does-not-make-himher-a-child-under-the-pocso-act","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2017\/07\/21\/mental-age-of-a-person-does-not-make-himher-a-child-under-the-pocso-act\/","title":{"rendered":"Mental age of a person does not make him\/her a \u201cChild\u201d under the POCSO Act"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Supreme Court<\/strong>: Refusing to expand the scope of the word \u2018child\u2019 under Section 2(d) of the Protection\u00a0of\u00a0Children\u00a0from\u00a0Sexual Offences\u00a0Act,\u00a02012\u00a0(POCSO\u00a0Act) to include\u00a0 the \u00a0 \u201cmental \u00a0 age\u201d \u00a0 of \u00a0 a \u00a0 person \u00a0 or \u00a0 the \u00a0 age determined \u00a0 by \u00a0 the \u00a0 prevalent \u00a0 science \u00a0 pertaining \u00a0 to psychiatry \u00a0 so \u00a0 that \u00a0 a \u00a0 mentally \u00a0 retarded \u00a0 person \u00a0 or \u00a0 an extremely\u00a0intellectually\u00a0\u00a0challenged\u00a0person\u00a0who\u00a0even\u00a0has crossed\u00a0the\u00a0biological\u00a0age\u00a0of\u00a018\u00a0years\u00a0can\u00a0be\u00a0included within\u00a0the\u00a0holistic\u00a0conception\u00a0of\u00a0the\u00a0term\u00a0\u201cchild\u201d, the bench of Dipak Misra and R.F. Nariman, JJ held that the\u00a0Parliament\u00a0has felt\u00a0it\u00a0appropriate\u00a0that\u00a0the\u00a0definition\u00a0of\u00a0the\u00a0term\u00a0\u201cage\u201d\u00a0by chronological \u00a0 age \u00a0 or \u00a0 biological \u00a0 age \u00a0 to \u00a0 be \u00a0 the \u00a0 safest yardstick \u00a0 than \u00a0 referring \u00a0 to \u00a0 a \u00a0 person \u00a0 having \u00a0 mental retardation.<\/p>\n<p style=\"text-align: justify;\">In the case where both the judges wrote their separate but concurring opinion, it was said that the\u00a0POCSO\u00a0Act\u00a0has\u00a0identified\u00a0minors\u00a0and\u00a0protected\u00a0them by\u00a0prescribing\u00a0the\u00a0statutory\u00a0age\u00a0which\u00a0has\u00a0nexus\u00a0with the\u00a0legal eligibility\u00a0to\u00a0give\u00a0consent.\u00a0It\u00a0may\u00a0be\u00a0due\u00a0to\u00a0the\u00a0fact\u00a0that\u00a0the\u00a0standards of\u00a0mental\u00a0retardation\u00a0are\u00a0different\u00a0and\u00a0they\u00a0require\u00a0to\u00a0be determined \u00a0 by \u00a0 an \u00a0 expert \u00a0 body. \u00a0 The \u00a0 degree \u00a0 is \u00a0 also different.\u00a0 If\u00a0a\u00a0victim\u00a0is\u00a0mentally\u00a0retarded,\u00a0definitely the\u00a0court\u00a0trying\u00a0the\u00a0case\u00a0shall\u00a0take\u00a0into\u00a0consideration whether \u00a0 there \u00a0 is \u00a0 a \u00a0 consent \u00a0 or \u00a0 not. \u00a0 In \u00a0 certain circumstances, it would depend upon the degree of retardation\u00a0or\u00a0degree\u00a0of\u00a0understanding.\u00a0It\u00a0should\u00a0never be\u00a0put\u00a0in\u00a0a\u00a0straight\u00a0jacket\u00a0formula.<\/p>\n<p style=\"text-align: justify;\">Explaining the scope of the power of the Court to interpret the word \u201cchild\u201d to give it a broader meaning, it was noticed that the legislature\u00a0despite\u00a0having\u00a0the\u00a0intent\u00a0in\u00a0its\u00a0Statement\u00a0of Objects \u00a0 and \u00a0 Reasons \u00a0 and \u00a0 the \u00a0 long \u00a0 Preamble \u00a0 to \u00a0 the POCSO\u00a0Act,\u00a0had\u00a0defined\u00a0the\u00a0term\u00a0\u201cage\u201d which\u00a0does\u00a0not\u00a0only\u00a0mention\u00a0a\u00a0child\u00a0\u00a0but\u00a0adds\u00a0the\u00a0words \u201cbelow\u00a0the\u00a0age\u00a0of\u00a018\u00a0years&#8221;. The Court said that had\u00a0the\u00a0word\u00a0\u201cchild\u201d\u00a0alone been\u00a0mentioned\u00a0in\u00a0the\u00a0Act,\u00a0the\u00a0scope\u00a0of\u00a0interpretation\u00a0by the\u00a0Courts\u00a0could\u00a0have\u00a0been\u00a0in\u00a0a\u00a0different\u00a0realm\u00a0and\u00a0the Court\u00a0might\u00a0have\u00a0deliberated\u00a0on\u00a0a\u00a0larger\u00a0canvass.<\/p>\n<p style=\"text-align: justify;\">The Court was hearing the appeal of a sexual assault victim suffering from Cerebral\u00a0Palsy due to which though being a 38-year-old, her mental age is no more than 6-8 years.
