{"id":141581,"date":"2017-07-11T12:31:23","date_gmt":"2017-07-11T07:01:23","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=141581"},"modified":"2017-07-11T12:31:23","modified_gmt":"2017-07-11T07:01:23","slug":"scheme-for-automated-listing-of-cases-before-the-supreme-court","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2017\/07\/11\/scheme-for-automated-listing-of-cases-before-the-supreme-court\/","title":{"rendered":"Scheme for automated listing of cases before the Supreme Court"},"content":{"rendered":"<p style=\"text-align: justify;\">The number of cases being filed in the Supreme Court of India has been\u00a0constantly on the rise and listing of cases is becoming acutely challenging. It\u00a0was felt that a higher level of objectivity, consistency, timeliness and\u00a0transparency was essential to bolster the aspirations of the stakeholders in the\u00a0judicial process. The only way forward to accentuate this goal is to rationalise\u00a0the docket so as to obviate the elimination of cases from the final list. Thus, a\u00a0new automated, dynamic and a responsive software (ICMIS) to integrate the\u00a0institutional processes both on the inter and intra circuit has been conceived\u00a0and launched on 10.05.2017 which will completely rule out manual<br \/>\nintervention too.<br \/>\nThe salient features of the new scheme are delineated as under:<br \/>\n<strong>FRESH\/AFTER NOTICE MATTERS<\/strong><br \/>\n1. No Miscellaneous matter shall remain undated. Every Miscellaneous\u00a0matter shall bear some date, either given by the Court or auto-generated by\u00a0the computer.<br \/>\n2. An attempt has been made to ensure even distribution of cases on a\u00a0given day before each court.<br \/>\n3. The ICMIS software has been designed to address relative urgency of\u00a0different types of cases as per the Supreme Court Rules, 2013 and the Practice\u00a0and Procedures in-vogue.<br \/>\n4. Fresh admission cases registered from Saturday to Tuesday will be\u00a0listed on the following Court working Monday or the notified miscellanous day\u00a0and fresh cases registered from Wednesday to Friday will be listed on next the\u00a0following Court working Friday or the notified Miscellaneous day, from the\u00a0date of removal of office objections, if any.<br \/>\n5. In case the defects are not cured within the statutory period of 28 days\u00a0and if an application for condonation of delay for removing defects is filed\u00a0after the 28th day till the 60th day, the matter shall be placed before the\u00a0Registrar\u2019s court.<br \/>\n6. In case the party fails to cure the defects till 90 days the matter shall be\u00a0listed in the following week before the Hon&#8217;ble Judge in Chambers.<br \/>\n7. Subject to the directions of Hon&#8217;ble the Chief Justice of India, ordinarily,\u00a0on miscellaneous days fresh matters not exceeding 45 and 15 after notice\/FD\u00a0matters will be listed before the concerned bench.<br \/>\n8. Ordinarily, on non-miscellaneous days subject to any directions of the\u00a0Hon&#8217;ble Chief Justice to the contrary upto 10 after notice (including Final\u00a0Disposal) matters and 10 Regular Hearing matters shall be listed before the\u00a0concerned bench.<br \/>\n9. Court dated pre-admission cases shall be listed on dates assigned by the\u00a0Court (including actual date notice) and shall not be left out. Pre-admission\u00a0matter ordered to be listed by the Hon\u2019ble Court in week commencing \/ next\u00a0week \/ after week(s) shall be treated as Court given date matter.<br \/>\n10. Over and apart from the fresh and actual date matters, cases in which\u00a0computer generated dates are given will also be listed within the specified\u00a0number of cases. However, if for any reason the aggregate number of\u00a0miscellaneous cases exceeds the computer generated date matters, they will<br \/>\nbe deferred in suitable lots after four weeks.<br \/>\n11. Not reached\/left over FRESH ADMISSION MATTERS shall be listed on\u00a0the following miscellaneous day. The not reached \/ left over after notice cases\u00a0will be assigned auto-generated returnable dates spread out in suitable lots\u00a0after four weeks. This is to ensure that the daily list \/ supplementary list for thefollowing week does not get oversized. The returnable dates of concerned<br \/>\ncases will be notified on the Supreme Court official website in the case status\u00a0of that case as also on the list\/board for the next Court working day, for the\u00a0information of the litigants and lawyers.<br \/>\nIn either case, if the Court orders to the contrary in exceptionally urgent\u00a0matters, the Court given date on mentioning will prevail.<br \/>\n12. Any urgent \/ left over matter\/fresh for admission matter required to be\u00a0listed on the next Court working day after preparation of final list will be\u00a0included in the supplementary list.<br \/>\n13. The matters of in-Person shall be listed after giving a clear notice of four\u00a0weeks and in case a party wants to get his\/her matter listed before the period\u00a0of four weeks he\/she may prefer a request in writing to the Registrar after the\u00a0completion of interaction as per rules.<br \/>\n14. Fresh matters are allocated as per subject category, unless coram is\u00a0given by Hon&#8217;ble the Chief Justice of India or is allocated by virtue of tagging as\u00a0per approved practices and procedures.<br \/>\n15. Subject to the orders of Hon&#8217;ble the Chief Justice of India, if the Hon\u2019ble\u00a0Court directs listing or tagging with a matter pending in another Court, and the\u00a0matter is listed accordingly, the coram of the main matter, with which the\u00a0matter is directed to be listed\/tagged will prevail.<br \/>\n16. If a fresh matter is listed before a Court and the Hon&#8217;ble Court directs to\u00a0list it before some other Bench or before a Bench of which one of the Hon&#8217;ble\u00a0Judges before whom the matter is listed, is not a member, it is treated as a\u00a0fresh matter and is listed through computer as per subject category, in the\u00a0next Final Cause List.<br \/>\n<strong>17. Classification of Cases for listing<\/strong><br \/>\nA. Personal Appearance<br \/>\nB. Settlement cases<br \/>\nC. Orders(Incomplete cases\/I.A.&#8217;s\/M.A.&#8217;s)<br \/>\nD. Fresh (for admission)<br \/>\nE. After notice (for admission)<br \/>\nF. Final Disposal (admission stage)<\/p>\n<p style=\"text-align: justify;\"><strong>REGULAR HEARING MATTERS<\/strong><br \/>\n18. Regular hearing matters shall be allocated as per Subject Category, if not\u00a0otherwise directed by Hon&#8217;ble the Chief Justice of India. If the Coram is\u00a0specified by Hon&#8217;ble the Chief Justice of India at the miscellaneous stage the\u00a0same will continue to be listed even after the grant of leave\/ Rule\u00a0Nisi\/Admission Stage, as per the Coram so granted.<br \/>\n19. Regular hearing matters shall be listed as per the oldest to the newest\u00a0(oldest matter first), depending upon the date of institution of the case, except\u00a0a specially directed matter.<br \/>\n20. (a) A Part Heard matter is to be listed before the Hon&#8217;ble Judges who\u00a0heard it in part unless it is released, in writing, from part heard.<br \/>\n(b) The Part Heard regular hearing matters which could not be heard or taken up by the Hon&#8217;ble Presiding Judge prior to retirement, shall be\u00a0listed before the second coram if presiding; otherwise the appropriate Court\u00a0as per
