{"id":135851,"date":"2017-06-09T10:03:03","date_gmt":"2017-06-09T04:33:03","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=135851"},"modified":"2017-06-21T12:52:39","modified_gmt":"2017-06-21T07:22:39","slug":"in-ip-infringement-cases-mere-delay-wont-defeat-grant-of-injunction","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2017\/06\/09\/in-ip-infringement-cases-mere-delay-wont-defeat-grant-of-injunction\/","title":{"rendered":"In IP infringement cases, mere delay won\u2019t defeat grant of injunction"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Madras High Court:<\/strong> While relying upon the Supreme Court decision in<em> Midas Hygiene\u00a0Industries (P) Ltd<\/em>. v. <em>Sudhir Bhatia<\/em>, <a href=\"http:\/\/www.scconline.com\/LoginForNewsLink\/a3PAOs2W\">(2004) 3 SCC 90<\/a>, the Single Bench of K. Kalyanasundaram,\u00a0J. has observed that an injunction would normally follow in the cases of infringement of \u00a0intellectual property rights, especially when the dishonesty qua the defendants was apparent, and\u00a0a mere delay would not be a ground to deny an order of interim injunction in such cases.<\/p>\n<p style=\"text-align: justify;\">The plaintiffs submitted that the defendants had deliberately copied their registered bottle design,\u00a0and thereby had caused design infringement and passed off their bottles as that of the plaintiffs.\u00a0The defendants contended that there was no novelty in the design of the plaintiffs since the\u00a0curves on the bottles and the vertical projection on the caps were functional features, and similar\u00a0designs were in public domain even prior to the plaintiffs\u2019 design registration, hence, the design\u00a0registration was invalid. The defendants also submitted that they had been selling the alleged infringing products from past five years to the knowledge of the plaintiffs, therefore, as per<a href=\"http:\/\/www.scconline.com\/LoginForDocumentLink\/5CHe8Dig\">\u00a0Section 41(g) of the Specific Relief Act<\/a>, the plaintiffs had acquiesced their right.<\/p>\n<p style=\"text-align: justify;\">The High Court noted that it was an admitted fact that the plaintiffs\u2019 design was registered in\u00a02008, whereas the defendants launched the impugned design only in 2011. Moreover, it was not\u00a0the case of the defendants that they were prior user of the design. The defendants had also not\u00a0produced any material to substantiate their submissions that the designs of the plaintiffs were not\u00a0new and the similar bottled designs had been used previously. Also, since the defendants\u00a0themselves claimed to be the registered proprietor of similar designs, hence, they could not be\u00a0permitted to approbate and reprobate as to the registrability of the bottle design. The Court also\u00a0noted that the utility of the grip of a bottle, or the feature to facilitate the opening of the cap,\u00a0could also be attained by other design options, therefore, such features could not be considered\u00a0as \u201cessentially functional\u201d. The Court, thus, concluded that the design of the plaintiffs had been\u00a0copied and adopted by the defendants, and the plaintiffs had made out a strong prima facie case\u00a0for the grant of interim injunction.
