{"id":134181,"date":"2017-05-29T12:36:43","date_gmt":"2017-05-29T07:06:43","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=134181"},"modified":"2017-05-29T12:36:43","modified_gmt":"2017-05-29T07:06:43","slug":"undertrial-detention-undergone-in-one-case-cannot-be-set-off-in-another-case","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2017\/05\/29\/undertrial-detention-undergone-in-one-case-cannot-be-set-off-in-another-case\/","title":{"rendered":"Undertrial detention undergone in one case cannot be set-off in another case"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Bombay High Court:<\/strong> While relying upon the Supreme Court decision in <em>Atul Manubhai Parekh<\/em>\u00a0v. <em>Central Bureau of Investigation<\/em>, <a href=\"http:\/\/www.scconline.com\/LoginForNewsLink\/98jNLmp7\">(2010) 1 SCC 603<\/a>, the Division Bench of Ranjit More, Anuja\u00a0Prabhudessai, JJ. has held that a convict is not entitled to get the period of undertrial detention\u00a0suffered in one case for set-\u00adoff against the sentence to be undergone in another case.<\/p>\n<p style=\"text-align: justify;\">The petitioner was sentenced to undergo ten years imprisonment for committing offences\u00a0punishable under POTA. The period of under-trial detention undergone by him was set-off under\u00a0Section 428 CrPC. The petitioner was also arrested for committing offences punishable under\u00a0Maharashtra Control of Organised Crime Act, after he was released on bail in the POTA case.\u00a0The petitioner, while placing reliance on the Supreme Court decision in <em>State of Maharashtra<\/em> v.\u00a0<em>Najakat Alia Mubarak Ali<\/em>, <a href=\"http:\/\/www.scconline.com\/LoginForNewsLink\/7u4L6jyL\">(2001) 6 SCC 311<\/a>, contended that the period for which he was under detention in\u00a0MCOC case was also to be set off as against the imprisonment imposed on him in the POTA\u00a0case.<\/p>\n<p style=\"text-align: justify;\">The High Court noted that in \u00a0<em>Najakat\u2019s case<\/em> the accused was arrested on the same day in two\u00a0criminal cases and he remained under concurrent detention for both the cases. The facts of <em>Najakat\u2019s case<\/em> were therefore distinguishable as the\u00a0petitioner, in the instant case,\u00a0was already\u00a0released on bail in the POTA case when he was undergoing detention in the MCOC case. The\u00a0Court observed that Section 428, in clear and unambiguous words, provides that the period of\u00a0sentence on conviction is to be reduced by the extent of detention already undergone by the\u00a0convict during investigation, enquiry or trial of the same case. Therefore, the period undergone\u00a0by the petitioner in the MCOC case could not be set off as against the sentence imposed in the\u00a0POTA case. [Saquib Abdul Hamid Nachan v.
