{"id":129851,"date":"2017-05-10T10:06:40","date_gmt":"2017-05-10T04:36:40","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=129851"},"modified":"2017-05-18T18:01:32","modified_gmt":"2017-05-18T12:31:32","slug":"directing-preliminary-inquiry-does-not-amount-to-taking-cognizance","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2017\/05\/10\/directing-preliminary-inquiry-does-not-amount-to-taking-cognizance\/","title":{"rendered":"Directing preliminary inquiry does not amount to \u2018taking cognizance\u2019"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Rajasthan High Court:<\/strong> While relying upon the Supreme Court decision in <em>Lalita Kumari<\/em> v.\u00a0<em>Government of Uttar Pradesh<\/em>,<a href=\"http:\/\/www.scconline.com\/LoginForNewsLink\/y3qCc6oR\"> (2014) 2 SCC 1<\/a>, the Single Bench of Pushpendra Singh Bhati, J.\u00a0has held that Section 19 of the Prevention of Corruption Act, 1988 mandates previous sanction of\u00a0the Government only for taking cognizance of certain offences, and the provision does not apply\u00a0to an order directing a preliminary inquiry.<\/p>\n<p style=\"text-align: justify;\">In the instant case, the petitioners had preferred criminal miscellaneous petitions for quashing\u00a0FIRs registered against them for the offences punishable under Section 13 of the Prevention of\u00a0Corruption Act. The Petitioners contended that since Section 19 of the Act provides that no court\u00a0shall take cognizance of an offence punishable under Sections 7, 10, 11, 13 and 15 without the\u00a0previous sanction of the Government, the FIRs were to be quashed.<\/p>\n<p style=\"text-align: justify;\">The Court noted that as the order under challenge only directed a preliminary inquiry, no\u00a0prejudice was caused to the petitioners so as to entitle them to challenge the same. In case, the\u00a0Anti-Corruption Bureau registered an FIR in the matter and if cognizance was sought to be taken\u00a0without sanction, then the petitioner would be at liberty to challenge the same by way of a fresh\u00a0petition under Section 482 CrPC.
